SUBJECT:
SUPPLEMENT 1 TO NUREG-0737: RE00EST FOR MODIFICATION OF COMMISSION ORDER DATED FEBRUARY 21, 1984, By letter dated March 20, 1984 (No. 1033), you requested that we extend the completion dates for certain items contained in the Comission Order dated February 21, 1984 relating to Supplement 1 to NUREG-0737. Your letter also brought to light a misinterpretation of Toledo Edison Company comitments with respect to the submission dates for certain implementation schedules.
We have reviewed the justifications you provided for the delays in the subnission dates for the DCRDR Summary Report and the report discussing the application of Regulatory Guide 1.97 to emergency response capabilities. We find that these justifications do not provide adeouate basis for modification of the Commission's Order. However, we agree with your assertions regarding the submission dates for the implementation schedules and are prepared to support a modification in this respect, after we have received your response to this letter.
Your letter incorrectly indicates that, at a presentation February 3,1984, the NRC staff was made aware of the potential, with a high degree of certainty, that certain dates given in response to Generic Letter 82-33 might not be met. Your letter expresses disappointment that the NRC did not take the initiative to elicit additional imput prior to issuing the Order.
l In this respect, notes taken by our staff indicate only that there could be l
slippage in the completion date for the DCRDR Summary Report - perhaps to j
April 30,1984 - but certainly not to June 30, 1984 as you are presently requesting. No slippage in the completion date for the Regulatory Guide 1.97 application report is so indicated.
In any event, the meeting to discuss the status of numerous NUREG-0737 items l
was not the proper way to request changes in schedules for actions which you had ample prior knowledge would be subject to a Commission Order.
It is the licensee's responsibility to assure adequate and timely communication of such information to the NRC via proper documentation.

With regard to the delay requested for submittal of the OCRDR Summary Report, you state that the additional time is required because the program scope was expanded since the original approach planned for the DCRDR has resulted in unacceptable DCRDR efforts by other licensees. Our staff reviewed the program plan you submitted on June 15, 1983 and you were informed on December 9, 1983 that provided the plan was executed as written the review should produce results fulfilling the requirements of Supplement I to NUREG-0737. The NRC staff has not altered this conclusion regarding the acceptability of a DCRDR conducted in strict accordance with your plan as originally described.
Your letter also indicates that you modified the program in early 1984 - after you had been informed of the staff's position. We conclude that the scope nodification to the DCRDR was voluntary on your part and was done without discussion with the NRC staff regarding the need for the modification or the impact it would have upon the completion date.
With regard to the delay requested for submittal of the report describing how the requirements of Supplement 1 to NUREG-0737 are being or will be met (application of Regulatory Guide 1.97) you state that you are conducting the review to Revision 3 that was issued in May 1983. This is acceptable even thought the Order requires the review to be conducted only to Revision 2.
You state that the delay in completion date is due to the fact that Regulatory Guide 1.97 indicates that certain additional non-Q-items not currently included in the Toledo Edison Environmental Qualification (EQ) Manual be cualified under the E0 program. However, with respect to environmental qualification there is no substantive difference in the requirements between the two revisions and, in certain respects, the. requirements of Revision 3 are considered to be less stringent than Revision 2, which was available at the time you provided the schedule for this item.
Unless adequate justification can be provided for delay in the submission of the two reports discussed above, the Commission's February 21, 1984 Order will not be modified with respect to these items.
In order to provide sufficient time for evaluation of any further justifications and to permit adminis-trative processing, your reply should reach us no later than April 4,1984.

Toledo Edison Company and Cleveland E ectric Illuminating Company (the licensees) are holders of Facility Operating License No. NPF-3 which authorizes the operation of the Davis-Besse Nuclear Power Station, Unit 1 (the fcility) at steady-state power levels not in excess of 2772 megawatts thermal. The facility is a Babcock and Wilcox (B&W) designed pressurized water reactor (PWR) located at the licensees' site in Ottawa County, Ohio.

The licensehs may request a hearing on this Order within 20 days of the date of publication of this Order in the Federal Reaister. Any request for hearing shall be submitted to the Director, Office of Nuclear Reactor Regulation, U. S. Nuclear Regulatory Comission, Washington, D.C. 20555. A copy of the reouest shall be sent to the Executive Legal Director at the same address.

P If a hearing. is to be held, the Commission will issue an Order designating the time and place of any such hearing. If a hearing is. held, the issue to be considered at such a hearing shall be whether this Order should be sustained.
This Order shall become effective upon the licensees' consent or upon expiration of the time within which the licensees may request a hearing or, if a hearing is requested by the licensees, on the date specified in an Order issued following further proceedings on this Order.
