ENCLOSURE 1 NOTICE OF VIOLATION Carolina Power and Light Company Docket No. 50-400 Shearon Harris License No. NPF-53 During the Nuclear Regulatory Commission (NRC) inspection conducted on November 17-21, 1986, a violation of NRC requirements was identified. The violation involved the licensee having inadequate housekeeping controls around the reactor vessel during initial fuel loading. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the violation is listed below:

10 CFR Part 50, Appendix B, Criterion II and the accepted Quality Assurance Program (Final Safety Analysis Report, Section 17.2.2) collectively require that activities affecting quality shall be accomplished under suitably controlled conditions. Controlled conditions include the use of appropriate equipment and suitable environmental conditions for accomplishing the activity, such as adequate cleanliness. The Shearon Harris Nuclear Power Plant (SHNPP) FSAR Section 1.8 commits to RG 1.39 (Rev. 2), " Housekeeping Requirements For Water Cooled Nuclear Power Plants," which endorses ANSI N45.2.3-1973, " Housekeeping During Construction Phase Of Nuclear Power Plants." ANSI N45.2.3 requires that for zones I, II, and III a written record of the entry and exit of all personnel and material shall be established and maintained.

Contrary to the above, on November 17 and 18 the licensee failed to maintain a record of entry and exit of all personnel and material in a Class B clean-liness zone which is the designated cleanliness area around the open reactor vessel.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including:

(1) admission or denial of the violation, (2) the reason for the violation if admitted. (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further viola-tions, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
