ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-369 and 50-370 McGuire License Nos. NPF-9 and NPF-17 During the Nuclear Regulatory Commission (NRC) inspection conducted on June 3-5, 1986, a violation of NRC requirements was identified.

The violation involved failure to adhere to radiological control procedures.

In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1985), the violation is listed below:

Technical Specification 6.8.1 requires that written procedures be established, implemented and maintained covering applicable procedures recommended ir Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Appendix A, Regulatory Guide 1.33, Paragraph 7.e.1, recommends that the licensee have radiation protection procedures to control access to radiation areas including a radiation work permit system.

Health Physics Manual Section 2.4, Radiation Work Permits, Paragraph 2.4.1, requires the issuance of radiation work permits (RWP) for a particular job in a particular area and on a specific piece of equipment or on a specific component and to delineate the specific protective clothing requirements.

Contrary to the above, specific protective clothing requirements were not delineated on RWP NO. 86-1183 in that verbal upgrades in radiological control requirements had been made without written RWP revisions such that on May 29, 1986, an individual in Unit 1 lower containment, who was following the written RWP, dressed inappropriately for the radiation hazard that had been determined to be present.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including (1) admission k

Docket Nos. 50-369 and 50-370 McGuire License Nos. NPF-9 and NPF-17 or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
