C.1 STATEMENT OF WORK OACKGROUND INFORMATION The Reactor and Plant Safety issues Branch (RPSIB) has the lead responsibility for rulemaking on renewal of nuclear power plant operating licenses.

Although license renewal is permitted under 10 CFR Chapter 1, the regulations provide no guidance to potential applicants as to what information and analyses should be submitted in support of renewal application and no guidance to the NRC staff as to how the application should be reviewed or what should be the terms and conditions of a renewed license.

The first application for license renewal is anticipated in 1991.

The RPSIB has a program underway to develop a license renewal rule.

The schedule calls for a proposed rule and supporting regulatory analysis to be completed by the Spring of 1989, to be published by the Fall of 1989, and for the final rule to be published in 1991.

To support this rulemaking, technical assistance is required in numerous areas of expertise including systems engineering, nuclear power plant design and operation, and related regulatory programs and requirements.

The MITRE Corporation, under Contract Number NRC-04-87-399, is providing overall support in the identification of regulatory options, alternative rules and specifications for conducting regulatory analyses of alternative license renewal rules.

Scientech Inc.

has supplemented MITRE's work with its special expertise in regulato-v requirements.

It is anticipated that additional expertise in engineering costing will be available through contracts now in place and administered by the Regulations Development Branch, RES.

As the analysis supporting rulemaking progresses, it is possible that special expertise in other areas may be required through additional contractual cssistance.

License renewal rulemaking has the potential for widespread impacts on other regulatory programs and requirements which need to be considered in performing a regulatory analysis on alternative license renewal rules.

Scientech Inc. has substantial expertise in the historical regulatory policy framework from which the current body of regulatory requirements has evolved and the understanding, through experience in their appiication, of the level of safety that the requirements provide.

Under Contract Number NRC-03-85-051, Modification 10, Scientech Inc. assisted in the review of i

"Regulatory Consideration of Issues Pertaining to Nuclear Plant License Renewal:

Status Report" which is being issued as a NUREG for public comment.

Their capabilities contributed to a clearer exposition of the relationship of existing regulatory programs to the regulatory options for license renewal.

OBJECTIVE 4

The objective of this contract is to provide specialized technical assistance to support the development of a proposed license renewal rule and a final license renewal rule.

The contractor will undertake certain review and analysis responsibilities to assist the staf f in assuring accurate and I

consistent representation of NRC's regulatory requirements and programs in documents developed to support rulemaking.

The contractor will also provide technical assistance in planning, organizing, and conducting public meetings.

WORK REQUIREMENTS Task 1 - Support the Development of a Propos.ed Lice.nse Rene.wal_ Rule Subtask 1.a, Alternative License Renewal Rules in this subtask, Scientech will undertake specific studies and will participate with the License Renewal Steering Committee and MITRE in critiquing documentation developed by MITRE which structure specific alternative rules for license renewal.

Scientech will especially focus on assuring that interrelationships of the proposed regulations and existing regulatory programs are clearly identified and accurated for.

This subtask is divided into four work elements.

(i)

Complete the computerized information base and analysis started under Contract Number NRC-03-85-051, Modification 10.

This data base focuses on Standard Review Plans (SRPs), recent policy statements, and includes summary evaluations of the applicability of SRPs, Regulatory Guides, and other regulatory guidance cited in the SRPs to license renewal.

There are approximately 220 SRPs and a dozen policy statements included in the data base.

In completing the data base Scientech will incorporate appropriate related information being developed in RES, NRR and MITRE.

Upgrading of the data base will be completed by early November 1988 and revised as determined necessary in the course of using it through the completion of Task 1.

Under this work element, one Scientech engineer will attend and assist the Task Manager in covering the sessions of the ANS Topical Meeting on Nuclear Power Plant Life Extension, July 31 to August 3,1988 in Snowbird, Utah.

This is a major international meeting of significance to license renewal rulemaking.

(ii)

Develop topical papers recommending positions on relationship of three existing regulatory requirements to license renewal.

These requirements are material alteration, backfit, and timing of license application. A briefing on the preliminary positions on the three requirements will be provided to NRC by mid-Octobei 1988 and final letter report by December 1988.

(iii)

Participate in review and discussions of MITRE documentation in the development of a proposed rule and alternative rules.

Under the contract previously identified, Scientech staf f attended briefings by HITRE in April and May 1988 on specification of proposed and alternative rules.

Based on the progress already made in the first work element above, Scientech will develop a report discussing the interrelationship of existing regulatory requirements and the proposed and alternative rules as specified in the previous HITRE briefings.

This report, of about 25 to 50 pages, will be completed by mid-September 1983.

Shortly after submittal, a meeting will be scheduled for discussion of the 1

letter report.

By the end of November, MITRE will submit a dra f t report which describes the proposed and alternative rules.

This report will likely be about 40 to 50 pages.

Scientech will review this report with regard to existing regulatory requirements; will participate in a one-day meeting to discuss the draft report, to be held about one week af ter the report is submitted; and will submit comments and recommendations for changes to the draf t reporc one week after the meeting.

(iv)

Based primarily on existing knowledge of foreign nuclear power regulatory programs, Scientech will develop a letter report recommending an approach to how foreign regulatory regimes should be considered in developing the proposed rule.

It is anticipated this report will be about 10 to 15 pages.

Subtask 1.6 - Public Meeting Scientech will assist the license Renewal Task Manager in planning, organizing, conducting and evaluating a two-day public meeting to discuss comments received on NUREG-1317, "Regulatory Options for Nuclear Plant license Renewal." The meeting is expected to be held in early November 1988, about four to five weeks after the close of the public comment period.

This subtatk is divided into three work olements.

(i)

Propose structure and approach for public meeting.

At least five days prior to the end of the comment period, Scientech will present its tentative proposed structure and approach to the Task Manager and other NRC staf f.

This meeting will be for one-half day.

About 75 to 100 responses ranging from one to as many as 100 pages are anticipated. Within eight days after the close of the comment period, Scientech will complete its.eview of the comments and deliver to the Task Manager a document which identifies priority issues to be covered, a proposed agenda, and a plan for organizing and conducting th? meeting.

It is anticipated that 10 to 20 priority issues will be identified.

A one-day meeting with appropriate NRC staff will be held after NRC's receipt of the document to determine the final agenda and agree upon details of how the public meeting is to be organized and conducted.

(11)

Support NRC in preparing for and conducting the public meeting.

Based upon the guidance provided by NRC in work element 1.b(i),

Scientech will draft a set of visual aids for each of the presentations to be made by NRC personnel.

These will be thoroughly reviewed with the NRC speaker and other appropriate NRC staff, end revised accordingly.

NRC speakers will be Branch Chiefs or higher, it is anticipated that about six NRC presentations will be made early in the agenda.

Scientech staff will monitor discussion during the public meeting and be prepared to respond to requests for information from the NRC staff.

(iii)

Evaluate public meeting.

Scientech will review the transcript of the public meeting 49d its own notes and evaluate any new information, or insights gained, with regard to existing

.e regulations and policies relative to the propose'd and al'ternative rules.

This report is due four weeks af ter the public meeting.

SubtaskJ.,c - Specifications for Regulatory Analysis A specifications document for conducting regulatory analyses of alternative license renewal rules will be developed by MITRE prior to performing the analyses and writing the Draf t Regulatory Analysis.

Scientech's contribution will be to participate in scoping, and reviewing the document and providing specified analysis to assure that the interrelationships of proposed alternative license renewal regulation and existing regulatory programs are fully addressed. An initial scoping meeting was heli in mid-May 1988 which Scientech attended under the previous contract.

A second scoping meeting will be held in late August 1988.

Scientech is responsible for providing a section of the specifications document covering the interrelationship of proposed alternative license renewal regulations and existing regulatory programs. A v aft specifications document is due in late November 1988.

Scientech will review the complete draft document to assure appropriate integration of the section for which it was responsible.

A one-day review meeting on the specifications document will be held about a week after it is received.

Scientech will of fer any required changes at that teeting.

This effort will build directly on the work accomplished in the previous subtasks. The products of this work element will be a report suitable for publication as an appendix to the Regulatory Analysis or as a separate NUREG/CR and a 10 to 15 page summary for inclusion as a section in the main body of the Regulatory Analysis.

The larger report will likely be 50 to 100 pages.

These documents are due by the end of January 1989.

Assist in the review and technical editing of the Regulatory Analysis.

During the month of February 1989, Scientech will participate in reviewing and editing the complete Regulatory Analysis Document to assure accuracy and consistency of treatment, not only in the areas for which it was responsible, but also throughout the document.

The initial review will be completed in mid-February 1989, at which time NRC staff and contractors will have a 2 to 3 day working session to discuss proposed changes, identify deficiencies, and assign responsibility for correcting the deficiencies.

Scientech may be assigned to correct some deficiencies.

The Regulatory Analysis will be ready for final editing by March 3,1989.

SuStask 1.e - A sistance Ouring NRC Review of Proposed _ Rule t

Scientech will provide assistance in preparing briefings, respond'ing to substantive questions raised during the internal review of tho rulemaking package, and revising the Regulatory Analysis when necessary.

At least five briefings will be required during the internal review period f rom March through August 1989.

The briefings will be to RES management, NRR and other interested Offices, CRGR, ACRS, and the Commission.

Given the technical and policy complexity of license renewal rulemaking, it is likely that numerous editorial and substantive changes will be required in the rulemaking package during the course of internal review.

The interrelationships of proposed alternative if cense renewal regulations and existing regulatory programs are expected to be of special interest and controversy,

_ Task 2 - Support the Development of a Final License Renewal Rule Subtask 2.a - Prepare _a J!eeds_ Rep _ ort on Regulatory Guidance Requirod to 1.mplement the Proposed License Re.newal Rule The Regulatory Analysis will include an overview discussion of the requirements for implementing license renewal regulations.

A more rigorous analysis must be undertaken, however, to specify the form and content of regulatory guidance required to implement the proposed role nn licenso renewal.

NRC must soon develop a work plan to ensure that necessary regulatory guidance, to applicants and staff reviewers, is in placo by tho early 1990s.

To aid NRC in developing a work plan, Scientech will prepare a needs report.

This needs report will systematically:

(1) identify all the topics and issues for which regulatory guida,ce is required; (2) rocommend form and centent of the guidance, being specific as to Regulatory Guides and Standard Review Plans; (3) identify ongving NRC programs directly relevant to the development of regulatory guidance; and (4) identify additional areas of research and analysis which should be undertaken to support the development of Regulatory Guides and Standard Review Plans for license renewal.

It is anticipated that the needs report will be between 100 and 150 pages in length.

This subtask is divided into six work elements.

(i)

Brief the Steering Committee on the proposed scope of the needs paper, in late January 1989.

Provide a 10 to 20 page discussion paper at least three days prior to the briefing.

The briefing will take one-half day.

S ub t.a s k. 2. b - Pub l i c _Me e_t i..n g s The staf f expects to hold one two-day meeting in the vicinity of each of the five NRC Regional Offices, shortly;after publication of the proposed license renewal rule in the Federal Regj ster, to discuss the content of and rational for the proposed rule.

It is anticipated that these meetings will be held in October and November 1989.

Scientech will assist the License Renewal Task Manager in planning, organizing and conducting those public meetings.

This subtask is divided into three work elements.

(i)

Support NRC in planning and preparing for the public meetings.

Based upon its understandinn of the proposed license renewal rule gained through participation in the development of the proposed rule, Scientech will submit a proposed structure and content for NRC presentations at the pubile meetings, by mid-August 1989.

NRC staf f will review the proposal and will provide further guidance for the development of the presentations.

By mid-September 1989, Scientech will furnish NRC with a set of visual aids for each presentation.

These will be reviewed by NRC staff who will meet with Scientech about a week af ter receipt to discuss the material and provide further guidance.

It is anticipated that five separate briefings running a total of about three hours will be prepared.

Scientech will also prepare six copies of a briefing book, by late September 1989, which will provide important background information and answer questions which may be asked of HRC speakers during the public meetings.

Support NRC in conducting the public meetings.

Scientech staff will monitor discussion during each public meeting and be prepared to respond to requests for information from the NRC staf f.

It is anticipated that two professional staf f members f rom Scientech will attend each public meeting.

(iii)

Evaluate public meeting.

transcripts of the public meetings and its own notes, and develop any information based on issues and concerns which can later be merged with written comments received on the proposed rule.

This information base shall be completed one month after the last public meeting.

Subtask 2.c - Respon.se.to_Publ.ic_ Comments it is anticipated that public comments on the proposed license renewal rule will be substantive and broad in scope. Approximately 200 responses are anticipated.

It is likely that many issues regarding interrelationships of the proposed license renewal regulation and existing regulatory programs will be raised and will require additional analyses to develop a staf f response.

This subtask is divided into three work elements.

(i)

Screen responses for comments related to the interrelationships of the proposed rule and existing regulatory programs.

At the same time, the staff and MITRE will be screening and ca(drizing.

The 3

results of the three sorting ef forts will be compared and comments j

assigned for draf ting responses.

It is assumed that there will be 200 responses received, averaging 10 pages each.

anticipated that thi work will be accomplished in January 1990.

It is anticipated that the document summarizing the responses to comments will be about 100 pages, Any inconsistencies found will be reviewed and resolved with the participation of the full review team.

It is anticipated that this work will be accomplished by late May 1990.

Subtask 2.d - Assess the Need to Revise the Proposed Rule and the lupportino Renulatory Analysis and Make_ the Necessary Revisions.

It is anticipated that some revision of the proposed rule and/or the Regulatory Analysis will be required, based on public comments and further staff deliberation of the proposed rule.

Scientech will assist in the assessment and make any required revisions relative to the topical areas for which it was responsible. This subtask is divided into two work elements.

At the same time the need to revise the Regulatory Analysis will be examined.

Relative to its topical areas of responsibility, Scientech will prepare appropriate briefing materials, and support staff discussion.

The workshop will be held in late April 1990.

Scientech will revise the sections of the Regulatory Analysis for which it has been responsible in accordance with guidance provided from the workshop.

Revisions will be submitted by early June 1990.

Subtask 2.e - Assistance During NRC Review of [_inal _ Rule Scientech will provide assistance in preparing briefings, responding to substantive questions raised during the internal review of the final rulemaking package, and in revising the rulemaking package when necessary.

Under Contract Number NRC-03-85-051 Modification 10, Scientech Inc. assisted in the review of "Regulatory Consideration of issues Pertaining to Nuclear Plant License Renewal:

Status Report" which is being issued as a NUREG for public comment.

Their capabilities contributed to a clearer exposition of the relationship of existing regulatory programs to the regulatory options for license renewal.

OBJECTIVE The objective of this contract is to provide specialized technical assistance to support the development of a proposed license renewal rule and i

WORK REQUIREMENTS Task 1 - Supp. ort the Development of a Proposed License Renewal. Rule Subtask 1.a - Alternative !icense Renewal Rules In this subtask, Scientech will undertake specific studies and will participate with the License Renewal Steering Committee and MITRE in critiquing documentation developed by MITRE which structure specific alternative rules for license renewal.

Scientech will especially fccus on assuring that interrelationships of the proposed regulaticns and esisting regulatory r.rograms are clearly identified and accurated for.

This subtask is divided into four work elements.

(i)

Complete the computerized information base and analysis started under Contract Number NRC-03-85-051, Modification 10.

This data base focuses on Standard Review Plans (SRPs), recent oolicy statements, and includes summary evaluations of the applicability of SRPs, Regulatory Guides, and other regulatory guidance cited in the SRPs to licer.se renewal.

There are approximately 220 SRPs and a dozen policy statements included in the data base.

in completing the data base Scientech will incorporate appropriate related information being developed in RES, NRR and MITRE.

Upgrading of the data base will be completed by early November 1988 and revised as determined necessary in the course of using it through the completion of Task 1.

Under this work element, one Scientech engineer will attend and assist the Task Manager in covering the sessions of the ANS Topical Meeting on Nuclear Power Plant Life Extension, July 31 to August 3, 1988 in Snowbird, Utah.

This is a major international meeting of significance to license renewal rulemaking.

(ii)

Develop topicai papers recommending positions on relationship of three existing regulatory requirements to license renewal.

These requirements are material alteration, backfit, and timing of license application. A briefing on the preliminary positions on the three requiremen.s will be provided to NRC by mid-October 1988 and final letter report by December 1988.

(iii)

Participate in review and discussions of MITRE documentation in the development of a proposed rule and alternative rules.

Under the contract previously identified, Scientech staff attended briefings by HITRE in April and May 1988 on specification of proposed and alternative rules.

This report will likely be about 40 to 50 pages.

Scientech will review this report with regard to existing regulatory requirements; will participate in a one-day meeting to discuss the draf t report, to be held about one week af ter the report is submitted; and will submit comments and recommendations for changes to the draf t report one week after the meeting.

(iv)

Based primarily on existing knowledge of foreign nuclear power regulatory programs, Scientech will develop a letter report recommending an approach to how foreign regulatory regimes should be considered in developing the proposed rule.

It is anticipated this report will be about 10 to 15 pages.

Subtask 1.b - public Meeting Scientech will assist the License Renewal T sk Manager in planning, t

organizing, conducting and evaluating a two-day public meeting to discuss comments received on NUREG-1317, "Regulatory Options for Nuclear plant License Renewal." The meeting is expected to be held in early November 1988, about four to five weeks af ter the close of the public comment period.

This subtask is divided into three work elements.

(i) propose structure and approach for public meeting. At least five days prior to the end of the comment period, Scientech will present its tentative proposed structure and approach to the Task i

Manager and other NRC staf f.

This meeting will be for one-half day. About 75 to 100 responses ranging from one to as nary as 100 pages are anticipated.

Within eight days af ter the close of the comment period, Scientech will complete Its review of the comments and deliver to the Task Manager a document which identifies

priority issues to be covered, a proposed agenda, and a plan for organizing and conducting the meeting.

It is anticipated that 10 to 20 priority issues will be identified.

A one-day meeting with appropriate NRC staff will be held af ter NRC's receipt of the document to deternine the final agenda and agree upon details of how the public meeting is to be organized and conducted.

(11)

Support NRC in preparing for and conducting the public meeting.

Based upon the guidance provided by NRC in work element 1.b(i),

Scientech will draf t a set of visual aids for each of the presentations to be made by NRC personnel.

These will be thoroughly reviewed with the NRC speaker and other appropriate NRC l

staff, and revised accordingly.

NRC speakers will be Branch Chiefs or higher.

It is anticipated that about six NRC presentations will be made early in the agenda.

Scientech staff will monitor discussion during the public meeting and be prepared to respond to requests for information f rom the NRC staf f.

(iii)

Evaluate public meeting.

Scientech will review the transcript of the public meeting and its own notes and evaluate an) new information, or insights gained, with regard to existing I

6 regulations and policies relative to the propose'd and al'ternative rules.

This report is due four weeks after the public. meeting.

Subt.ask.l.c - Specifications for Regulatory Analysis A specifications document for conducting regulatory analyses of alternative license renewal rules will be developed by MITRE prior to performing the analyses and writing the Draf t Regulatory Analysis.

Scientech's contribution will be to participate in scoping, and reviewing the document and providing specified analysis to assure that the interrelationships of proposed alternative license renewal regulation and existing regulatory programs are fully addressed. An initial scoping meeting was held in mid-May 1988 which Scientech attended under the previous contract.

A second scoping meeting will be held in late August 1988.

Scientech is responsible for providing a section of the specifications document covering the interrelationship of proposed alternative license renewal regulations and ex i s t ing regula tory programs. A dra f t speci fica tions document is due in late November 1988.

Scientech will review the complete draf t document to assure appropriate integration of the section for which it was responsible.

A one-day review meeting on the specifications document will be held about a week af ter it is received.

Scientech will offer any required changos at that meeting.

Subta.sk 1.d - Draf t ut gulatory Analysis A Draft Regulatory Analysis will be written during the period December 1988 through February 1989.

This subtask is divided into two work elements.

(i)

Scientech will be responsible for writing the section on the interrelationships of proposed alternative license renewal regulations and existing regulations, policies, and programs.

This ef fort will build directly on the work accomplished in the previous subtasks.

The products of this work element will be a report suitable for publication as an appendix to the Regulatory Analysis or as a separate NUREG/CR and a 10 to 15 page summary for inclusion as a section in the nain body of the Regulatory Analysis.

The larger report will likely be 50 to 100 pages.

These documents are due by the end of January 1989.

Assist in the review and technical editing of the Regulatory Analysis.

During the month of February 1989, Scientech will participate in reviewing and editing the complete Regulatory Analysis Document to assure accuracy and consistency of treatment, not only in the areas for which it was responsible, but also throughout the document.

The initial review will be completed in mid-February 1989, at which time NRC staff and contractors will have a 2 to 3 day working session to discuss proposed changes, identify deficiencies, and assign responsibility for correcting the deficiencies.

Scientech may be assigned to correct some deficiencies.

The Regulatory Analysis will be ready for final editing by March 3,1989.

Subtask 1.e - Assistance During_NRC Revi_ew of Proposed Rule

Subtask 2.b - Pub.lic Mee_t_ings The staff expects to hold one two-day meeting in the vicinity of each of the five NRC Regional Of fices, shortlyiaf ter publication of the proncsed license renewal rule in the Federal Regi_ ster, to discuss the content of and rational for the proposed rule, it is anticipated that these meetings will be held in October and November 1989.

Scientech will assist the license Renewal Task Manager in planning, organizing and conducting those public meetings.

This subtask is divided into three work elements.

(1)

Support NRC in planning and preparing for the public meetings.

i Based upon its understanding of the proposed license renewal rule gained through participation in the development of the proposed rule, Scientech will submit a proposed structure and content for NRC presentations at the public meetings, by mid-August 1989.

NRC staff will review the proposal and will provide further guidance for the development of the presentations.

By mid-September 1989, Scientech will furnish NRC with a set of visual aids for each presentation.

These will be reviewed by NRC staff who will meet i

with Scientech about a week 4f ter receipt to discuss the material and provide further guidance.

It is anticipated that five I

separate briefings running a total of about three hours will be prepared.

Scientech will also prepare six copies of a briefing book, by late September 1989, which will provide important background information and answer questions which may be asked of NRC speakers during the public meetings.

Scientech staff will monitor discussion during each public meeting and be prepared to respond to requests for information from the NRC staff.

It is anticipated that two professional staff members from Scientech will attend each publir meeting.

This information base shall be completed one month after the last public meeting.

Subtask 2..c - Response to P_ublic. Comments it is anticipated that public comments on the proposed license renewal rule will be substantive and broad in scope.

Approximately 200 responses are anticipated.

It is likely that many issues regarding interrelationships of the proposed license renewal regulation and existing regulatory programs will be raised and will require additional analyses to develop a staff response.

This subtask is divided into three work elements.

(i)

Screen responses for comments related to the interrelationships of the proposed rule and existing regulatory programs.

At tha same time, the staf f and MITRE will be screening and ca(3rizing.

The results of the three sorting efforts will be compared and comments assigned for drafting responses.

It is assumed that there will be 200 responses received, averaging 10 pages each, it is anticipated that this work will be accomplished in January 1990.

(ii) 1 ' aft responses to public comments.

it is anticipated that the interrelationships of the proposed rule and existing regulatory programs will be one of the major areas industry will focus on.

Comments will likely range from substar.tive issues not previously treated, or inadequately treated, to those needing only clarification through minor editing.

It is anticipated that Scientech will be assigned:

6 major substantive issues to handle; 12 minor issues to treat; and, 20 routine issues needing clarification rathet 'han new or additional analyses.

This effort includes gathering required information, additional analyses, drafting, review by NRC, and rewriting.

It is anticipated that this work will be accomplished during the period February 1990 through early May 1990.

(iii)

Participate in a final comprehensive review of all responses to public comments to assure consistency with the responses drafted by Scientech.

It is anticipated that the document summarizing the responses to comments will be about 100 pages Any inconsistencies found will be reviewed and resolved with the participation of the full review team.

It is anticipated that this work will be accomplished by late May 1990.

C,1 STATEMENT OF WORK BACKGROUND INFORMATION The Reactor and Plant Safety Issues Branch (RpSIB) has the lead responsibility for rulemaking on renewal of nuclear power plant operating licenses. Although license renewal is permitted under 10 CFR Chapter 1, the regulations provide no guidance to potential applicants as to what information and analyses should be submitted in support of renewal application and no guidance to the NRC staff as to how the application should be reviewed or what should be the terms and conditions of a renewed l ic e rise.

The first application for license renewal is anticipated in 1991.

The RPSIB has a program underway to develop a license renewal rule.

The schedule calls for a proposed rule and supporting regulatory analysis to be completed by the Spring of 1989, to be published by the Fall of 1989, and for the final ru'e to be published in 1991.

To support this rulemaking, technical assistance is required in numerous areas of expertise including systems engineering, nuclear power. plant design and operation, and related regulatory programs and requirements.

The MITRE Corporation, under Contract Number NRC-04-87-399, is providing overall support in the identification of 1

regulatory options, alternative rules and specifications for conducting regulatory analyses of alternative license renewal rules.

Scientech Inc.

has supplemented MITRE's work with its special expertise in regulatory requirements.

it is anticipated that additional expertise in engineering costing will be available through contracts now in place and administered by the Regulations Development Branch, RES.

As the analysis supporting rulemaking progresses, it is possible that special expertise in other areas may be required through additional contractual assistance.

WORK REQUIREMENTS Task.1 - Support the Development of.a Propos.ed_ Lice _nse. Renewal _ Ru.le Subt.ask_1.a - Al_te.rnative Lt. cense Renewal Rules In this subtask. Scientech otill undertake specific st' dies and will participate with the License Renewal Steering Committee and MITRE in critiquing documentation developed by MITRE which structure specific alternative rules for license renewal.

Scientech will especially focus on assuring that interrelationships of the proposed regulations and en t sting regulatory programs are clearly identified and accurated for.

This subtask is divided into four work elements.

(t)

Complete the computerized information base and analysis started under Contract Number NRC-03-85-05), Modification 10.

This data base focuses on Standard Review Plans (SRPs), recent policy statements, and includes summary evaluations of the applicability of SRPs, Regulatory Guides, and other regulatory cuidance cited in the SRPs to license renewal.

There are approximately 220 SRPs and a dozen policy statements included in the data base.

In completing the data base Scientech will incorporate appropriate related information being developed in RES, NRR and MITRE.

j Upgrading of the data base will be completed by early November 1988 and revised as determined necessary in the course of using it i

through the completion of Task 1.

Under this work element, one Scientech engineer will attend and assist the Task Manager in covering the sessions of the ANS Topical Meeting on Nuclear Power Plant Life Extension, July 31 to August 3,1988 in Snowbird, Utah.

This is a major international meeting of significance to license renewal rulemaking.

(ii)

Develop topical papars recommending positions on relationship of j

three existing regulatory requirenents to license renewal.

These l

requirements are material alteration, backfit, and timing of license application. A briefing on the prelininary positions on i

the three requirements will be provided to NRC by mid-October 1988 and final letter report by December 1988.

(111)

Participate in review and discussions of MITRE documentation in the development of a proposed rule and alternative rules, Under the contract previously identified, Scientech staff attended briefings by HITRE in April and May 1988 on specification of proposed and alternative rules.

Based on the progress already made in the first work element above Scientech will develop a report discussing the interrelationshir of existing regulatory requirements and the proposed and alternative rules as specified in the previous MITRE briefings.

This report, of about 25 to 50 i

pages, will be completed by mid-September 1988.

Shortly after submittal, a meeting will be scheduled for discussion of the

letter report.

By the end of November, MITRE will submit a draf t report which describes the proposed and alternative rules.

This report will likely be about 40 to 50 pages.

Scientech will review j

this report with regard to existing regulatory requirements; will participate in a one-day meeting to discuss the draft report, to be held about one week af ter the report is submitted; and will submit comments and recommendations for changes to the draf t report one week after the meeting.

(iv)

Based prinarily on existing knowledge of foreign nuclear power regulatory programs, Scientech will develop a letter report recommending an approach to how foreign regulatory regimes should be considered in developing the proposed rule, it is anticipated this report will be about 10 to 15 pages.

2 Subtask 1.b - public Meeting Scientech will assist the Ltcense Renewal Task Manager in planning, organizing, conducting and evaluating a two-day public meeting to discuss j

comments received on NUREG-1317, "Regulatory Options for Nuclear plant License Renewal " The meeting is expected to be held in early November 1988, about four to five weeks af ter the close of the public comment period.

This subtask is divided into three work elements.

(i) propose structure and approach for public meeting.

At least five 1

days prior to the end of the comment period, Scientech will present its tentative proposed structure and approach to the Task Manager and other NRC staf f.

This meeting will be for one-half day.

About 75 to 100 responses ranging from one to as many as 100 pages are anticipated.

Within eight days after the close of the 1

comment period. Scientech will complete its review of the comments 1

and deliver to the Task Manager a document which identifies l

priority issues to be covered, a proposed agenda, and a plan for

~

organizing and conducting the meeting, It is anticipated that 10 to 20 priority issues will be identified.

A one-day meeting with appropriate NRC staff will be held af ter NRC's receipt of the j

document to determine the final agenda and agree upon details of how the public meeting is to be organized and conducted.

f (ii)

Support NRC in preparing for and conducting the public meeting.

Based upon the guidance provided by NRC in work element 1.b(1),

Scientech will draf t a set of visual aids for each of the presentations to be made by NRC personnel.

These will be thoroughly reviewed with the NRC speaker and other appropriate NRC staff, and revised accordingly.

NRC speakers will be Branch d

Chiefs or higher.

It is anticipated that about six NRC presentations will be made early in the agenda.

Scientech staff will monitor discussion during the pubtle meeting and be prepared I

i to respond to requests for information from the NRC staff.

(iii)

Evaluate public meeting.

Scientech will review the transcript of the public meeting and its own notes and evaluate any new information, or insights gained, with regard to existing 1

regulations and policies relative to the propose'd and al'tornative rules.

This report is due four weeks after the publir meeting.

5_ubtask _l.c - Specifications for Regulatory Analysis A specifications document for conducting regulatory analyses of alternative license renewal rules will be developed by MITRE prior to performing the analyses and writing the Draf t Regulatory Analysis.

Scientech's contribution will be to participate in scoping, and reviewing the document L

and providing specified analysis to assure that the interrelationships of proposed alternative license renewal regulation and existing regulatory programs are f ully addre ssed. An initial scoping meeting was hold in nid-May 1988 which Scientech attended under the previous contract A second scoping necting will be held in late August 1988.

Scientech is responsible for providing a section of the specifications document covering tha interrelationship of proposed altcrnative license renewal regulations and entsting regulatory programs. A draf t specifications document is due in late November 1988.

Scientech will review the complete draft docurent to assure appropriate integration of the section for which it was responsible.

A one-day review m(eting on the specifications document will be held about a week after it is rec 3ived.

Scientech will offer any required changes at that meeting.

Sub_ta sL 1,d - Dr,a f t Regul.atory Analysi s A Draft Regulatory Analysis will be written during the period Cecerbor 1988 through February 1989.

This subtask is divided into two work elements.

(i)

Scientech will be responsible for writing the section on the interrelationships of proposed alternative license renewal regulations and existing regulations, policies, and programs.

This ef fort will build directly on the work accomphshed in the previous subtasks.

The products of this work element will be a report suitable for publication as an appendia to the Regulatory Analysis or as a separate NUREG/CR and a 10 to 15 page summary for inclusion as a section in the main body of the Regulatory Analysis.

The larger report will likely be 50 to 100 pages.

These documents are due by the end of January 1989.

(ii)

Assist in the review and technical editing of the Regulatory Analysis.

During the month of February 1989. Scientech will participate in reviewing and editing the complete Regulatory Analysis Document to assure accuracy and consistency of treatment, i

not only in the areas for which it was responsibi3, but also threughout the document.

The initial review will be completed in mid-February 1989, at which time NRC staf f and contractors will have a 2 to 3 day workiss session to discuss prorcstd changes, identify deficiencies, and assign responsibility for correcting i

the deficiencies Scientech may be assigned to correct some deficiencies.

Nee _ds Report _gry Regulatory Guidance Required to Irplement the Proposed License Renewal Rule The Regulatory Analysis will include an overview discussion cf the requirements for irtplementing license renewal regulations.

A move rigorous analysis must be undertaken, however, to specify the form and content of regulatory guidance required to irnplement the proposed rule on liennse rereaal.

of research and analysis which should be undertaken to support the development of Regulatory Guides and Standard Review Plans for license renewal.

It is anticipated that the needs report will be between 100 and j

150 pages in length.

This subtask is divided into sin work elements.

A one-to-two-day meeting will be held about a week thereaf ter for $ctentech and NRC staf f to discuss the report and comment on it.

The final report will be due four weeks after the review meeting.

It is anticipated that the report will be 100 to 150 pages in length.

Subta_sk 2,b - Public Meetings The staff espects to hold one two-day meeting in the vicinity of each of the five NRC Regional Offices, shortlylafter publication of the proposed license renewal rule in the Federal Reg.is_ter, to discuss the content of and rational for the proposed rule.

It is anticipated that these meetings will be held in October and November 1989.

Scientech will assist the License Renewal Task Manager in planning, organizing and conducting those public meetings.

This subtask is divided into three work elements.

(1)

Support NRC in planning and preparing for the pub'ic meetings.

Based upon its understanding of the proposed lic(nse renewal rule gained through participation in the development of the proposed rule, Scientech will submit a proposed structure and content for NRC presentations at the public meetings, by mid-August 1989.

NRC staf f will review the proposal and will provide further guidance for the development of the prescatations.

By mid-September 1989, Scientech will furnish NRC with a set of visual aids for each presentation.

These will be reviewed by NRC staff who will meet with Scientech about a week af ter receipt to discus <, the material and provide further guidance.

It is anticipated that five separate briefings running a total of about three hours will be prepared.

Scientech will also prepare sfr copies of a briefing book, by late September 1989, which will provide important background information and answer questions which may be asked of NRC speakers during the public meetings.

Support NRC in conducting the public meetings.

Scientech staff will monitor discussion during each pubite meeting and be prepared to respond to requests for information from the NRC staf f.

It is anticipated that two professional staff members from Scientech will attend each public meeting.

Evaluate public necting.

Scientech will review the

transcripts of the public meetings and its own notes, and develop any information based on issues and concerns which can later be merged with written comments received on the proposed rule.

This information base shall be completed one month after the last I

oublic meeting.

I Subtas}._2,c - Response to Public Comments it is anticipated that public comments on the proposed license renewal rule will be substantive and broad in scope, Approximately 200 responses are anticipated.

It is likely that many issues regarding interrelationships of l

the proposed license renewal regulation 4 J existing reculatory programs will be raised and will require additional analyses to develop a staf f response.

This suhtask is divided into three wnrk elements.

I (1)

Screen responses for com! rents related to the interrelationships of i

the proposed rule and existing regulatory programs.

At the same time, the staf f aa.d MITRE will be screening and ca$rizing.

The results of the three sorting efforts will be compared and comments assigned for drafting responses.

It is assumed that there will be 200 responses received, averaging 10 pages each.

anticipated that this work will be accomplished in January 1990.

It is anticipated that the

/ WORK STATEMENT C.1 STATEMENT OF WORK (MAR 1987) 8ACKGROUND INFORMATION The Reactor and Plant Safety Issues Branch (RPSIB) has the lead rr'sponsibility for rulemaking on renewal of nuclear power plant operating licenses.

Although license renewal is permitted under 10 CFR Chapter 1, the regulations provide no guidance to potential applicants as to what information and analyses should be submitted i

in support of renewal appilcation and no guidance to the NRC staff as to how the application should be reviewed or what should be the terms and conditions of a renewed license.

The first application.

for. license renewal is anticipated in 1991.

The RPSIB has a program underway to develop a license renewal rule.

The schedule calls for a proposed rule and supporting regulatory analysis to be completed by the Spring of 1989, to be published by the Fall of 1989, and for the final rule to be published in 1991.

To support this rulemaking technical assistance is required in numerous areas of expertise including systems engineering, nuclear power plant design and operation, and related regulatory programs and requirements.

The MITRE Corporation, under Contract Number NRC-04-87-399, is providing overall support in the identification of regulatory options, alternative rules and specifications for conducting regulatory analyses of alternative Itcense renewal rules.

Scientech Inc. has supplemented MITRE's work with its special expertise in regulatory requirements.

It is anticipated that additional expertise in engineering costing will be available j

through contracts now in place and administered by the Regulations Development Branch, RES.

As the analysis supporting rulemaking progresses, it is possible that special expertise in other areas i

may be required through additional contractual assistance, l

l License renewal rulemaking has the potential for widespread impacts on other regulatory programs and requirements which need to be considered in performing a regulatory analysis on alternative iicenso renewal rules.

Their capab!11ttes contributed to a clearer exposition of the relationship of existing regulatory programs to the regulatory options for if cense renewal.

OBJECTIVE The objective of this contract is to provide specialized technical assistance to support the development of a proposed license renewal rule and a final license renewal rule.

The contractor will undertake certain review and analysis responsibilities to assist the staff in assuring accurate and consistent representation of NRC's regulatory requirements and programs in documents ieveloped to support rulemaking.

The contractor will also provide technical and administrative assistance in planning, organizing, and conducting public meetings.

WORK REQUIREMENTS Task 1 - Support the Development of a Proposed License Renewal Rule Subtask 1.a - Alternative License Renewal Rules In this subtask Scientech shall participate with the License Renewal Steering Committee in critiquing documentation developed by MITRE which structure specific alternative rules for license renewal and identifies additional information and analysis requirements. Once documentation has been completed by MITRE, it will be made available for Scientech's review.

Scientech will especially focus on assuring that interrelationships of the proposed regulations and existing regulatory programs are c1early identified and accounted for.

Documentation is scheduled to be available for Scientech's review in mid-May 1988 and October 1988.

Scientech shall meet with.' TITRE and the Steering Committee af ter each submittal of documentation (a total of two neetings).

t At these meetings Scientech will be prepared to discuss the adequacy of treatment of the interralationships of the proposed 4

regulations and existing regulatory programs.

These meetings will be held in Bethesda, Maryland and will be one day in duration, i

i Subsequent to each meeting, Scientech will develop its comments in a letter report which will be submitted within three weeks of the meeting.

Subtask 1.b - Public Meeting i

Scientech will assist the License Renewal Task Manager in planning, organizing, conducting and evaluating a public meeting to discuss comments received on the NUREG, "Regulatory Consideration of Issues Pertaining to Nuclear Plant License Renewal:

Status Report." The meeting is expected to be held in mid-October 1988, six weeks after the close of the comment l

period.

This two-day meeting is to be held in Bethesda, Maryland.

Subtask 1.c - Specifications for Regulatory Analysis A snecifications document for conducting regulatory analyses of

to Scientech performing the analyses and providing input to the Draft Regulatory Analysis NUREG.

Scientech shall participate in scoping and reviewing the document and providing specified analysis to assure that the interrelationships of proposed alternative license renewal regulation and existing regulatory programs are fully addressed. A scoping meeting will be held in May in Bethesda, Maryland and is expected to last for 1 1/2 days.

Scientech's specific res;01sibilities will be to provide analyses and written input for the specifications document.

It is estimated that this function will take 1 1/2 staff-months and is expected to take 4-6 weeks.

A draft specifications document is due from MITRE in early July.

The document will be revised to accommodate information and issues identified in public comments on the regulatory options NUREG and the subsequent public meeting, identified in subtask 1.b, Scientech's input to the revised specifications document is due two weeks after the public meeting which is anticipat2d to be held by the end of October 1988.

Subtask 1.d - Draf t Regulatory Analysis A Draft Regulatory Analysis NUREG, to support license renewal r

rulemaking, is scheduled to be developed during the period November 1988 through Februtry 1989.

After the specifications r

document is completed (subtask 1.c) Scientech will have the responsibility of preparing input to sections of the Regulatory Analysis concerning the interrelationships of proposed alternative r

license renewal regulations and existing regulatory programs.

Scientech will also participate in reviewing the complete Draft Regulatory Analysis.

The Oraf t Regulatory Analysis is scheduled tu be completed for Steering Committee and participating contractor review in early January 1989.

Subtask 2.b - Public Meetings The staff expects to hold one two-day meeting in the vicinity of each of the Regional offices shortly after publication of the i

proposed license renewal rule in the Federal Register to discuss the content of and rational for the proposed rule.

It is anticipated these meetings will be in November 1989.

Scientech will assist the License Renewal Task Manager in planning, organizing and conducting these public meetings.

Subtask 2.c - Response to Pubite Comments i

It is anticipated that pubite comments on the proposed rule will be substantive and broad in scope.

It is likely that many issues regarding interrelationships of the proposed alternative license renewal regulation and existing regulatory programs will be raised which will require additional analyset to develo; a staff response.

Scientech will support the staff by performing approximately six major and twelve minor analyses assigned to.It and by participating in the review of approximately ten major and i

ten minor analyses performed by other contractors, as appropriate.

This work will be conducted during the period t

January through April 1990.

Subtask 2.d - Revise Regulatory Analysis l

It is anticipated that some revision of the Regulatory Analysis will be required based on the staff response to the public I

comments.

The Contractor shall proceed promptly with the performance of technical directions duly issued by the Project Officer in the manner prescribed by this clause and within such person's authority under the provisions of this clause.

f.

If, in the opinion of the Contractor, any instruction or direction issued by the Project Of ficer is within one of the categories as defined in c above, the Contractor shall not proceed but shall notify the Contracting Of ficer in writing within five (5) working days af ter the receipt of any such instruction or direction and shall request the Contracting Officer to modify the contract accordingly.

Upon receiving such notification from the Contractor, the Contracting Officer shall issue an appropriate contract modification or advise the Contractor in writing that, in the Contracting Officer's opinion, the technical direction is within the scope of this article and does not constitute a change under the Changes Clause.

g.

Any unauthorized commitment or direction issued by the

Assisting the Contractor in the resolution of technical problems encountered during performance.

3)

Reviewing all costs requested for reimbursement by Contractor and submitting to the Contracting Officer recommendations for approval, disapproval, or siispension of payment for supplies and services required under this contract.

G.3 TRAVEL REIMBURSEMENT (MAR 1987) a.

The Contractor will be reimbursed for reasonable domestic travel costs incurred directly and specifically in the performance of this contract.

The cost limitations for travel costs are determined '" the Federal Travel Regulations that are in effect on the date of the trip.

These Regulations specify the daily maximum per dien rates for specific Iccalities within the Conterminous United States (CONUS), the standard CONUS rate, the allowance for meals and incidental expenses (M&IE), the cost of travel by privately owned automobile, and the items which require receipts.

The Contractor can obtain the Regulations from the Superintendent of Documents, Government Printing Office, Washington, DC 20402.

When the Governtaent changes the Federal Travel Regulations, it is the responsibility of the Contractor to notify the Contracting Officer in accordance with the Limitation of Cost clause of this contract if the Contractor will be unable to make all

of the approved trips and remain within the cost and fee limitations of this contract.

(a) Invoice Payments (1) For purposes of this clause, "invoice payment" means a Gosernment disbursement of monies to a Contractor under a contract or other authorization for supplies or services accepted by the Government. (2) Except as indicated in subparagraph (a)(3, of this clause, the due date for making invoice payments by the dt ignated payment office shall be the later of the following two events:

(i) The 30th day after the designated billing office has received a proper invoice from the Contractor.

(11) The 30th day af ter Government acceptance ot' supplies delivered or services performed by the Contractor. On a final invoice where the payment amount is subject to contract settlement actions, acceptance shall be deemed to have occurred on the effective date of the contract settlement.

(3) The due date on contracts for meat and meat food products, cortracts for perishable agricultural commodities, and contracts not

(1) The due date for meat and meat food products, as defined in Section 2(a)(3) of the Packers and Stockyard Act of 1921 (7 U.S.C.

182(3)) and further defined in Pub. L.98-181 to include poultry, poultry products, eggs, and egg products, will be as close as possible to, but not later than, the 7th day af ter product delivery.

(ii) The due date for perishable agricultural commodities, as defined in Section 1(4) of the Perishable Agricultural Commodities Act of 1930 (7 U.S.C. 499a(44)), will be as close as possible to, but not later than, the 10th day af ter product delivery, unless another date is specified in the contract.

(iii) If the contract does not require submission of an invoice for paynent (e.g., periodic lease payments), the due date will be as specified in the contract.

(4) An invoice is the Contractor's bill or written request for payment under the contract for supplies delivered or services performed. An invoice shall be prepared and submitted to the designated billing officer specified in the contract. A proper invoice must include the items listed in subdivisions (a)(4)(1) through (a)(4)(/iii) of this clause. If the invoice does not comply with tnese requirements, then the Contractor will be notified of the defect within 15 days after receipt of the invoice at the designated billing office (3 days for meat and meat food products and 5 days for ps.-',hable agricultural commodities). Untimely notification will be taken into account in the computation of any interest penalty cwed the Contractor in the manner described in subparagrpah (a)(6) of this clause.

(i) Name and address of the Contractor.

(ii) Invoice date.

I (iii) Contract number or other authorization for supplies delivered or services performed (including order number and contract line item number). (iv) Description, quantity, unit of measure, unit l

(v) Shipping and payment terms (e.g., shipment number and date of shipment, prompt payment discount terms). Bill of lading number and weight of shipment will be shown for shipments on Government bills of lading.

(vi) Name and address of Contractor official to whom payment is to be sent (must be the same as that in the contract or in a proper notice of assignment).

(vii) N.we (where practicable), title, phone number and mailing address of person to be notified in event of a defective invoice.

(5) An interest penalty shall be paid automatically by the Government, without request from the Contractor, if payment is not made within 15 days after the due date (3 days for meat and meat food products and 5 days for perishable agricultural commodities) and the following conditions are met, if applicable: (i) A proper invoice was received 'oy the designated billing of fice.

(ii) A receiving report or other Government documentation authorizing payment was processed and there was no disagreement over quantity, quality, or contractor compliance with any contract term or condition.

(iii) In the case of a final invoice for any balance of funds due the Contractor for supplies delivered or services performed, the amount was not subject to further contract settlement actions between the Government and the Contractor.

(6) The interest penalty shall be the rate established by the Secretary of the Treasury under Section 12 of the Contract Dispuws Act of 1978 (41 U.S.C. 611) that is in effect on the payment date, except where the interest penalty is prescribed by other governmental authority. This rate is referred to as the "Renegotiation Board Interest Rate," and it is published in the Federal Register semiannually on or about January 1 and July 1. The interest penalty shall accrue daily on the invoice payment amount approved by the Government and be compounded in 30-day increments inclusive from the first day after the due date through the payment date. That is, interest accrued at the end of any 30-day period will l

be added to the approved invoice payment amount ind be subject to interest penalties if not paid in the succeeding 30-day period. If 1

(A) The period taken to notify the Contractor of defects in invoices submitted to the Government, but this may nnt exceed 15 days (3 days for meat and meat food products and 5 days for perishable agricultural commodities).

(B) The period between the defects notice and resubmission of the corrected invoice by the Contractor.

(iii) Interest penalties will not continue to accrue after the filing of a claim for such penalties under the Olsputes clause or for more than 1 year. Interest penalties of less than $1.00 need not be paid.

(iv) Interest penalties are not required on payment delays due to disagreement between the Government and Contractor over the payment amount or other issues involving contract compliance or on amounts temporarily withheld or retained in accordance with the terms of the contract. Claims involving disputes, and any interest that may be payable, will be resolved in accordance with the Disputes clause.

(7) An interest penalty shall also be paid automatically by the designated payment office, without request from the contractor, if an improperly taken discount for prompt payment was not Corrected within 15 days after the expiration of the discount period (3 days for meat and meat food products and 5 days for perishable agricultural commodities). The interest. penalty will be calculated as described in paragraph (a)(6) of this clause on the amount of discount taken for the perio) b ainning with the first day after the end of the discount period through the date when the contractor is paid.

(b) Contract Financing Payments (1) For purposes of this clause, "contract financing payment" means a Government disbursement of monies to a Contractor under a contract clause or other authorization prior to acceptance of supplies or services by the Government. Contract financing payments include advance payments, progress payments based on cost under the clause at 52.232-16, Progress Payments, progress payments based on a percentage or stage of completion (32.102(e)(1)) other than those made under the clause at 52.232-5, Payments Under Fixed-Price Construction Contracts, or the clause at 52.232-10, Payments Under Fixed-Price Architect-Engineer Contracts, and interim payments on cost type contracts.

(2) For contracts that provide for contract financing, requests for payment shall be submitted to the designated billing office as specified in this contract or as directed by the Contracting Officer. (4) The documents furnishing the information required in this paragraph (c) mu!t be dated and contain the signature, title, and telephone number of the Contractor of ficial authorized to provide it, as well as the Contractor's name and contract number.

(5) Contractor failure to properly designate a financial institution or to provide appropriate payee bank account information may delay payments of amounts otherwise properly due.

SECTION H - SPECIAL CONTRACT REQUIREMENTS H.1 KEY PERSONNEL (MAR 1987) a.

The following individuals are considered to be essential to the successful performance of the work hereunder.

The Contractor agrees that such personnel shall not be removed from the contract work or replaced without compliance with paragraphs b and c hereof.

b.

If one or more of the key personnel for whatever resson becomes, or is expected to become, unavailable for work under this contract for a continuous peried exceeding 30 work days, or is expected to devote substantially less effort to the work than indicated in the proposal or initially anticipated, the Contractor shall immediately notify the Contracting Of ficer and shall, subject to the concurrence of the Contracting Officer, promptly replace such personnel with personnel of at least substantially equal ability and qualifications.

c.

All requests for approval of substitutions hereunder must be in writing and provide a detailed explanation of the circumstances necessitating the proposed substitutions.

They contain a complete resume for the proposed substitute, and other information requestad by the Contracting Officer to approve or disapprove the proposed substitution.

The Contracting Officer will evaluate such requests and promptly notify the Contractor of his/her approval or disapproval thereof in writing.

d.

If the Contracting Officer determines that:

1) Suttable and timely replacement of key personnel who have been reassigned, terminated or have otherwise become unavailable for the contract work is not reasonably forthcoming; or
2) That the resultant reduction of effort would be so substantial as to impair the successful completion of the contract or the service order, the contract may be terminated by the Contracting Officer for default or for the convenience of the t

Government, as appropriate. If the Contracting Offf;er finds the Contractor at fault for thn condition, the contract price or fixed I

fee may be equitabiy adjusted downward to compensate the Government for any resultant delay, loss or damage.

H.2 SAFETY, HEALTH, AND FIRE PROTECTION (MAR 1987)

The Contractor shall take all reasonable precautions in the performance cf the work under this contract to protect the health and safety of employees and of members of the public and to minimize danger from all hazards to life and property and shall comply with all applicable health, safety, and fire protection regulations and requirements (including reporting requirements) of the Commission and the Department of Labor.

In the event that the Contractor fails to comply with said regulations or requirements, the Contracting Officer, may, without prejudice to any other legal or contractual rights of the Commission, issue an order stopping all or any part of the work; thereaf ter, a start order for resumption of work may be issued at the discretion of the Contracting Officer.

The Contractor shall make no claim for an extension of time or for compensation or damages by reason of or in connection with such work stoppage.

H.3 OISSEMINATION OF CONTRACT INFORMATION (MAR 1987)

The Centractcr shall comply with the attached requirement of NRC Manuai Chapter 3202 and 3206 (See Section J for List of Attacnments) regarding publications or any information, oral or written, concerning the work performed under this contract.

Failure to comply with this clause shall be grounds for termination of this contract.

H.4 PRIVATE USE CF CONTRACT INFORMATION AND DATA (MAR 1987)

Except as specifically authorized by this contract, or as otherwise approved by the Contracting Of ficer, information and other data developed or acquired by or furnished the Contractor in the performance of this contract, shall be used only in connection with the work under this contract.

H.5 DRAWINGS, DESIGNS, AND SPECIFICATIONS (MAR 1987)

All drawings, sketches, designs, design data, specifications, notebooks, technical and scientific data, and all photographs, negatives, reports, findings, recommendations, data and memoranda of every description relating thereto, as well as all copies of the foregoing relating to the work or any part thereto, shall be subject to inspection by the Commission at all reasonable times (for which inspection the proper facilities shall be afforded the Commission by the Contractor.nd its subcontractors), shall be the prsporty of the

' whatsoever without any claim on the part of the Contractor and its subcontractors and vendors for additional compensation and shall, subject to the right of the Contractor to retain a copy of said material for its own use, be delivered to the Government, or otherwise disposed of by the Contractor either as the Contracting Officer may from time to time direct during the progress of the work or in any event as the Contracting Of ficer shall direct upon completion or termination of this contract.

The Contractor's right of retention and use shall be subject to the security, patent, ard use of information provisions, if any, of this contract.

H.6 CONTRACTOR ORGANIZATIONAL CONFLICTS OF INTEREST (OMB CLEARANCE NUMBER 3150-0112) (MAR 1987) a.

Purpose.

The primary purpose of this clause is to aid in ensuring that the Contractor:

1)

Is not placed on a conflicting role because of current or planned interest (financial, contractual, organizational, or otherwise) which relate to the work under this contract, and

2) Does not obtain an unfair competitive advantage over other parties by virtue of its performance of this contract.

b.

Scope.

The restrictions described herein shall apply to performance or participation by the Contractor as defined in 41 CFR 20-1.5402(f) in the activities covered by this clause.

c.

Work for Others.

Notwithstanding any other provision of this contract, during the term of tnis contract, the Contractor agrees to forgo entering into consulting or other contractual arrangements with any firm or organization, the result of which may give rise to conflict of interest with respect to the work being performed under this contract.

The Contractor shall ensure that all employees who are employed full time under this contract and employees designated as key personnal, if any, unde this contract abide by the provision of this clause.

If the Contractor believes with respect to itself or any such employee that any proposed consultant or other contractual arrangement with any firm or l

organization may involve a potential conflict of interest, the I

Contractor shall obtain the written approval of the Contracting l

Officer prior to execution of such contractual arrangement.

d.

Disclosure after award.

Access to and use of information.

1)

If the Contractor in the performance of this contract obtains access to information, such as NRC plans, policies, reports, studies, financial plans, internal data protected by the Privac; Act of 1974 (Pub. L.93-579), or data which has not been released to the public, the Contractor agrees not to:

(i)

Use such information for any private purpose until the information has been released to the public; (ii)

Compete for work for the Commission based on such information for a period of six (6) months after either the completion of this contract or the release of such information to the public, whichever is first; (iii) Submit an unsolicited proposal to the Government based on such information until one year after the release of such information to the public, or (iv)

Release the information without prior written approval by the Contracting Officer unless such information has previously been released to the public by the NRC.

2)

In addition, the Contractor agrees that tu the extent it receives or is given access to proprietary data, data protected b/ the Privacy Act of 1974 (Pub. L.93-579), or other confidential or privileged technical, business, or financial information under this contract, the Contractor shall treat such information in accordance with restrictions placed on use of the information.

3)

The Contractor shall have, subject to patent and security provisions of this contract, the right to use technical data it produces under this cnntract for private purposes provided that all requirements of this contract have been met.

f.

Subcontracts.

Except as provided in 41 CFR 20-1.5402(h),

the Contractor shall include this clause, including this paragraph, in subcontracts of any tier.

The terms "contract," "Contractor,"

and "Contracting Officer," shall be appropriately modified to preserve the Government's rights, g.

Remedies.

For breach of any of the above prescriptions or for intentional nondisclosure or misrepresentation of any relevant interest required to be disclosed concerning this contract or for such erroneous representations as necessarily imply bad faith, the Goverrrent may terminate the contract for default, disqualify the Contractor from subs?quent contractual efforts, and pursue other

(3) The Contractor shall cooperate fully with any Federal acency investigating a possible violation described in paragraph (b) of this clause.

(4) Regardless of the contract tier at which a kickback was provided, accepted or charged under the contract in violation of paragraph (b) of this clause, the Contracting Officer may--

(1) Offset the amount of the tickback againist any monies owed by the United States under this contract and/or (11) direct that the Contractor withhold from sums owed the subcontractor, the amount of kickback. The Contracting Of ficer may order that monies withheld under subdivision (c)(4)(ii) of this clause be paid over to the Government unless the Government has already offset those monies under subdivision (c)(4)(1) of this clause.

In the latter case, the contractor shall notify the Contracting Officer when monies are witheld.

I.3 SPECIAL 8(A) CONTRACT CONDITIONS (FAR 52.219-11) (APR 1984)

The Small Business Administration (SBA) agrees to the following:

(a) To furnish the supplies or services set forth in this contract

e..ording to the specifications and the terms and conditions hereof by subcontracting with an eligible concern pursuant to the provisions of section 8(a) of the Small Business Act, as amended (15 U.S.C. 637(a)).

(b) That in the event SBA does not award a sube.ntract for all or a part of the work hereunder, this contract may be terminated either in whole or in part without cost to either party.

(c) Delegates to the Nuclear RegulatoryCommission the responsibility for administering the subcontract to be awarded hereunder with complete authority to take any action on behalf of the Government under the terms and conditions of the subcontract; provided, however, that the Nuclear RegulatoryCaission shall give advance notice to the SBA before it issues a final notice terminating the right of a subcontractor to proceed with further performance, either in whole or in part, under the subcontract for default or for the convenience of the Government.

(d) That payments to be made under any subcontract awarded under this contract will be made directly to the subcontractor by the Nuclear RegulatoryCommission.

(e) That the subcontractor awarded a subcontract hereunder shall

(End of Clause) 1.4 PAYMENT FOR OVERTIME PREMIUMS (FAR 52.222-2) (APR 1984)

(a) The use of overtime is authorized under this contract if the overtime premium cost does not exceed $0, In addition to this dollar ceiling, overtime is permitted only for work--

(1) Necessary to cope with emergencies such as those resulting from accidents, natural disasters, breakdowns of production equipment, or occasional production bottlenecks of a sporadic nature; (2) By indirect-labor employees such as those performing duties in connection with administration, protection, transportation, maintenance, standby plant protection, operation of utilities, or accounting; (3) To perform tests, industrial processes, laboratory procedures, loading or unloading of transportation conveyances, and operations in flight or af' oat that are continuous in nature and cannot reasonably be interrupted or completed otherwise; or (4) That will result in lower overall costs to the Government.

(b) Any request for estimated overtime premiums that exceeds the amount specified above shall include all estimated overtime for contract completion and shall--

(1) Identify the work unit; e.g.,

department or section in which the requested overtime will be used, together with present workload, staffing, and other data of the affected unit sufficient to permit the Contracting Of ficer to evaluate the necessity for the overtime; (2) Demonstrate the effect that denial of the request will have on the cen*.ract delivery or performance schedule; (3) Identify the extent to which approval of overtime would affect the performance or payments in connection with other Government contracts, together with identification of each affected contract; and (4) Provide reasons why the required work cannot be performed by using multishift operations or by employing additional personnel.
