Dear Mr. Chairman:

This is in response to your letters of January 25 and March I regarding reported unauthorized employment activities of U.S.

citizens in South Africa's nuclear power program.

First, let me say that I regret the time it has taken to respond to your inquiries, but to accomplish our review and to coordinate our response was of necessity a time-consuming matter. is a report by the NRC sta.ff giving the results of j

an informal inquiry which was conducted by the EDO staff to obtain the information and the documents you requested, and describing the approach used by the $taff in conducting this inquiry. is a report of s similar inquiry of the

Commissioners and the members of the Con. mission's own staf f and the ACRS.

In summary..I personally in October 1984, and some of the staff even earlier, had heard that South Africa was recruiting U.S. citizens for its nuclear power program (see Enclosures for details).

At that time, according to the information contained in the enclosures, there were no indications that any necessary U.S. Government approvals were not being sought.

In mid-November, the NRC staff first learned from the Executive Branch of some possible unauthorized activities by U.S. citizens assisting South Africa's nuclear power program.

It should be noted that NRC is not responsible for investigations of compliance with DOE's regulations, including Part 810.

Although NRC comments on 10 CFR Part 810 requests as required by the Atomic Energy Act, we are not responsible for enforcement of this portfon of the Act.
