Dear Congressman Howard:

This is in response to your letter of June 4,1986, to Mr. C. Kanunerer of the Nuclear Regulatory Commission's (NRC's) Office of Congressional Affairs who has referred the letter to me for response.

Your letter was in regard to the letter of May 29, 1986, to you from Mr. Thomas J. Cotov, a constituent of yours.

In his letter, Mr. Cotov referenced statements made by two NRC Commissioners to the House Energy, Conservation and Power Subcommittee on May 22, 1986, about the relative safety of the operatica of the_0yster Creek Nuclear Generating Station and requested that. NRC conduct a full invest 1gatTon of Oyster Creek.~

Investigations of the kind which your constituent requested be performed by NRC of the Oyster Creek Nuclear Generating Station are, in fact, regularly perfomed by the NRC in its Systematic Assessment of Licensee Performance (SALP). This program is conducted at approximately 12-18 month intervals of each nuclear power plant licensee. The SALP is an integrated NRC staff effort to collect available observations and data on the operations of a nuclear plant to evaluate licensee performance.

It is intended to promote quality and safety of plant operations and modifications. The contents of the resulting SALP report are the observations and data made by both inspection and licensing personnel of the NRC staff. Ten functional areas are assessed as follows: plant operations, radiological controls, maintenance, surveillance and inservice testing, fire protection and housekeeping, emergency preparedness, security and safeguards, outage management and refueling, technical support and licensing activities.

The criteria for the assessments of each functional area are identified in to this letter. This effort by NRC is extensive and involves a fomal SALP Board, which issues a report on the NRC conclusions to the licensee at the end of the SALP rating period. This report is then reviewed wich the licensee in a public meeting.

The last complete SALP rating period for Oyster Creek covered the period May 1, 1984, to June 30, 1985. The SALP report was issued by NRC Region I on October 11, 1985. This report is provided as Enclosure 2, as I believe it may be useful for your constituent to gain significantly more insight regarding the extent that NPC evaluates the licensee during the SALP review.

_2-The category ratings of 1, 2, and 3 are discussed in Enclosure 1 on the criteria for the SALP review. The highest rating would be a 1; the lowest rating would be a 3.

A ma,iority of the category ratinos for this plant are "2", indicating that NRC attention should be maintained at normal levels.

In two of the ten category ratings, this plant was rated as "1" and, for one category, as "3".

The present SALP rating period for Oyster Creek ends October 15, 1986. A SALP report should be issued in November and the meeting with the licensee is expected in December.

I trust that this response addresses the concern raised by Mr. Cotov.
