Dear Ms. Holmes:
l-This refers to your license application dated March 15,1999 for the export of 30,000 kilograms of deuterium oxide (heavy water) to Canada, and the accompanying check for $7,900.00 to cover the licensing fee. NRC has assigned the application a license number of XMAT0397.
This is to advise you that the licensing fee is $1,200.00 rather than $7,900.00. Our regulations i
do not require Commission and Executive Branch reviews of export license applications i
involving shipments of heavy water to Canada, in contrast to _ heavy water exports to other countries (see 10 CFR Parts 110.40(b)(3) and 110.41(a)(3)). Additionally, NRC does not have to obtain, via the Executive Branch, case-by case assurances from Canada regarding the controls it will apply to the heavy water. Such assurances have been given to the U.S. on a
. long-term, generic basis.: Thus, the NRC staff can complete the review and processing of-l application XMAT0397 on its own accord, reducing the licensing fee to $1200.00 3
l By copy of this letter we are asking the NRC Office of the Chief Financial Officer to forward to Aldrich Chemical Company a refund check in the amount of $6,700.00.
