Inspection Report No. 70-1201/86-02 Gentlemen:
This letter addresses the findings noted in Inspection Report No. 70-1201/86-02.
The inspection was performed by Mr. J. W.
Bates and S. Q. Ninh of your office on May 13-16, 1986.
During the course of the inspection, a violation of the NRC requirements was identified.
Since the response to the violation is exempt from disclosure under the provisions of 10 CFR 2.790(d), specific discussion of the findings is being forwarded as Attachment I to this letter.
The information contained herein is true and correct to the best of our knowledge and belief.

License Condition 2.1 of Safeguards Amendment MPP-2 to Special Nuclear Material License No.
SNM-1168 requires that the licensee follow his approved Fundamental Nuclear Material Control (FNMC) Plan dated September 21, 1983, and as revised in accordance with the provisions of 10 CFR 70.32(c). Section 8.2.1.4 of the FNMC plan states in part that a final written audit report will be sent to management within 60 calendar days of completion of the audit.
Contrary to the above, a contractor audit was performed at Ledoux and Company by the licensee on January 14, 1986 and was not distributed for review by management as required.
This is a Severity Level V violation (Supplement III).
Response
1.
Admission or Deni al of the Alleged Violation We acknowledge the validity of the facts contained in the notice of violation.
2.
Reasons for Violation A contractor audit is performed once a year as required by our FNMC Plan and a audit report is prepared and distributed to appropriate management. This violation was a failure to follow established procedures.
3.
Corrective Steps Taken and Result Achieved Personnel performing contractor audits have reviewed requirements of the FNMC Plan / Procedures and have been made aware of the importance of informing management of the audit results by distributing the audit report.
Distribution of the audit report for the audit taken on January 14, 1986 of Ledoux and Company has been made for management review.
4.
Corrective Steps Which Will Be Taken to Avoid Further Violation Personnel performing contractor audits have been instructed to review procedures prior to each audit.
