CHAMMAN May 4, 1987 The Honorable Arthur E. Morris Mayor of Lancaster P. O. Box 1559 Lancaster, Pennsylvania 17605 Dear Mr. Chairman On April 16, 1987, the Commission met with the Advisory Panel to discuss the disposal of the accident-generated water at TMI-2.
This meeting was very helpful in bringing to the Commission's attention both the collective and individual views of the Panel on this important issue.
During the meeting, a discussion arose concerning the appropriate timing for a Commission decision on the disposal of the accident-generated water at TMI-2.
A number of Panel members expressed the view that the water disposal issue should be resolved as quickly as practicable.
Other Panelists questioned the need for any action at this time.
The Commission would greatly appreciate the Panel's advice on the appropriate time frame for a final Commission decision on this issue.
Since we plan to readdress the water disposal issue in late July /early August, 1987, following the publication of the NRC staff's final environmental impact statement and the Commission's receipt of staff's recommendation on the licensee's evaporation proposal, it would be helpful to receive the Panel's recommendation prior to this time period.
We are cognizant of the time and effort the Panel has devoted in compiling information on the various issues involved with the decontamination of TMI-2 and thank you for your attention to this particular request.

Dear Senator Humphrey:
I am responding to your letter dated April 3, 1987 regarding the Atomic Safety and Licensing Board's Partial Initial Decision of March 25, 1987 authorizing issuance of a low-power operating license for the Seabrook nuclear reactor.
In its consideration of ALAB-853 the Commission stayed the Director of the Office of Nuclear Reactor Regulation from issuing such a license pending completion of Commissien review of that Appeal Board decision.
The single issue on review was whether a low power license should be issued absent any emergency plan for that part of the plume exposure emergency plan zone that lies in Massachusetts (Massachusetts EPZ).
On April 9, 1987 the Commission concluded its review and decided that the Seabrook applicant must file an emergency plan for t
the Massachusetts EPZ before even a low power license can be issued.
Accordingly, the stay was left in place.

l On the eve of its April 9 decision, the Commission received from the Seabrook applicant (1) a notification that it was filing an emergency plan for the Massachusetts EP7, (2) a suggestion of mootness as a result of the filing, and (3) a request to lift the stay.
Nonetheless, the Commission proceeded with its decision, but said it would respond l
subsequently to the Seabrook applicant after full opportunity for response by participants in the Seabrook proceeding.
A briefing schedule was established which should enable the Commission to consider those matters in May.
Because this matter is in formal ad,iudication, the Commission cannot comment on its prospective decisions, and the Commission may entertain viaws on the issues and decide those issues only on the record.
