We have completed our review of your request dated November 7,1986, for an exemption from the annual fee requirements of 10 CFR 171 until such time as the Shoreham Nuclear Power Station is licensed to operate above 5% power operation.
It is your position that while Long Island Lighting Company (LILCO) has had a license since December 1984, you have not been authorized to exceed 5% power operstion due to problems associated with the refusals by State and local governments to participate in emergency planning for Shoreham which would permit operation above 5% pcwer.
In addition to not being able to produce marketable electrical energy, you stated that your Company is faced with increased costs associated with protracted licensing proceedings because of the lack of cooperation by the State and local governments.
Based on our evaluation of your request in accordance with the provisions of 10 CFR 171.11, we have determined that an exemption from the annual fee requirements of 10 CFR 171 should be granted. This exemption is limited to FY 1987 and only until such time as LILCO is authorized to operate the Shoreham reactor above 5% power operation.
In reaching our conclusion on your request, we took into consideration the unique circumstances associated with the protracted licensing proceedings and the fact that the 5% power limitation on your operation of Shoreham is not due to any failure or negligence on LILCO's part in fulfilling the requirements of 10 CFR 50 and other applicable NRC regulations.
Consistent with the requirements of 10 CFR 171,19, your Company paid the FY 198/ first quarterly payment of $237,500 for Shoreham. Since you have been exempted from the annual fees for FY 1987, we are taking the necessary steps to refund to you the $237,500 payment. This refund will be accomplished by electronic transfer within a week after your receipt of this letter.
In the event your Company receives authority to operate above 5% power before September 30, 1987, LILC0 will become subject to the annual fees of 10 CFR 171 and we will send you an invoice for the applicable prorated amount for the remainder of the fiscal year.
