Description Of The Information Collection l

l Under its mandate to protect the public health and safety, the Commission

- is requesting information from licensees authorized to possess certain large=

quantities of radioactive material.

The proposed amendments to Parts 30, 40 and 70 would require licensees authorized to possess in excess of certain quantities of by product materials,

source materials, or special nuclear materials to consider potential accidents characteristic of their facility and submit emergency plans for responding to releases or an evaluation that shows a plan is not needed.

! Thus the NRC is proposing to require the respondents to submit"either:

(i) An evaluation showing that the' maximum dose to a member of the public-l offsite due to a credible release of radioactive materials would not exceed j 1 rem effective dose equivalent [6 30.32(g)(1)(i), 9 40.31(i)(1)(i),

5 70.22(i)(1)(i)], or (ii) An emergency plan for responding to a release of radioactive materials

[9 30.32(g)(1)(ii), 9 40.31(1)(1)(11), S 70.22(1)(1)(11)].

The licensee must allow the offsite response organizations expected to respond in case of an accident 60 days to comment on the licensee's emergency plan before submitting it to NRC. The licensee must provide any comments i received within the 60 days to the NRC with the emergency plan [6 30.32(g)(4),

8 40.31(1)(4), 5 70.22(1)(4)].

If a licensee wants to change the plan, the licensee must submit the change to the Commission [6 30.34(f), S 40.35(f), 670.32(1)].

i A. JUSTIFICATION j

1. Need for the Collection of Information i

The NRC wants to assure that a licensee's response to a significant acci-dental release of radioactive materials will be adequate to protect public health and safety. This can best be done if the licensee has planned to re-4 spond to identified types of accidents. The emergency plan submitted to NRC would allow NRC to determine that planning is adequate.

2. Agency Use of the Information A Part 30 licensee authorized to possess byproduct material submits the information to NRC Repional Offices-in accordance with instructions in 10 CFR 30.6(b). For licensees who submit an evaluation, NRC staff members review and approve or reject the evaluation and place it in the appropriate docket file to document that the licensee has submitted the required evaluation. In the case of Part 30 licensees who submit emergency plans, NRC staf,f members will determine if the information provides emergency plans that are adequate (see 10 CFR 30.33(a)(2)). Under new 10 CFR 30.34(f), iicensees required to j - submit emergency plans in accordance with 10 CFR !0.32(g) must follow and main-tain in effect emergency plans approved by the Commi:: ion. _ Inspectors from NRC Regional Offices will use the information to determine whether the licensees comply with new 10 CFR 30.34(f).

7 A Part 40 licensee authorized to possess source material in the fuel cycle submits the information to the Director, NMSS, Washington, DC 20555. For li-censees who submit an evaluation, NRC staff members review and approve or reject i the evaluation and place it in the appropriate docket file to document that the

licensee has submitted the required evaluation. In the' case of Part 40 licensees r

j who submit emergency plans, NRC staff members will determine if the most recent I

information plus the previous information provides emergency plans that are-I adequate (see 10 CFR 40.32(b)). Under new 10 CFR 40 35(f), licensees required to submit emergency plans in accordance with 10 CFR 40.32(f) must follow and maintain in effect emergency plans approved by the Commission.. Inspectors from NRC Regional Offices will use the information to determine whether the licensees comply with new 10 CFR 40.35(f).

'< A Part 70 licensee authorized to possess special nuclear material in a plutonium processing or fuel fabrication plant submits the information to the Director, NMSS, USNRC, Washington, DC 20555. Other licensees covered by pro-posed 10 CFR 70.22(1) submit the information to NRC Regional Offices in accordance with instructions in 10 CFR 70.5. For licensees who submit an evaluation, NRC staff members review and approve or reject the evaluation and place it in the appropriate docket file to document that the licensee has submitted the required l evaluation. ! The Federal Information Locator System was searched to determine NRC and other Federal agency duplication. The information that would be required is similar to that submitted in 1981 after NRC issued orders to licensees. How-ever, complete resubmission of plans is necessary because of a new requirement that offsite response organizations, primarily local fire, police, and medical

, departments, be given the plan by the licensee to comment on. Since the organi-zations do not have previous submittals by the licensee, they must be provided with the plan in its entirety.

5. Effort to Use Similar Information l

Licensees expected to submit emergency plans may do so by making relatively minor changes in previous emergency plans filed with the Commission.
