i DOCKETS 50-266 and 50-301 1 10 CFR 50 APPENDIX R EXEMPTION REQUESTS POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 In my letter dated June 11, 1986, Wisconsin Electric Power Company requests, pursuant to the provisions of 10 CFR 50.12, exemptions from the automatic fire suppression system requirements prescribed in Section III.G.3.b of 10 CFR 50 Appendix R for the component cooling water (CCW) heat exchanger and boric acid tank room and the computer and instrument rack room at Point Beach Nuclear Plant, Units 1 and 2. At the time of that submittal, we neglected to include the $150 application fee specified in the Commission's regulation at 10 CFR 170.21.

Accordingly, we are remitting herewith a check in the amount of

$150 for this application fee.

The enclosures to our June 22, 1986 letter concluded that the exemptions should be granted on the basis that the existing fire protection features, together with alternate shutdown capabilities for the components in question, provide a level of fire protection equivalent to the technical requirements of Section III, G.3.b of Appendix R. We believe, therefore, that application of this regulation in these particular circumstances is not necessary to achieve the underlying purpose of the rule which is to provide adequate fire hazards protection.

Accordingly, we have further concluded that the special circumstances contemplated by Paragraph (a)(2)(ii) of 10 CFR 50.12 are present, and the Commission may consider the granting of these exemptions. ,
