SUBJECT:

Special Inspection No.93-014 On September 30,1993, S. Courtemanche and S. Shaffer of this office conducted a special safety inspection at your facility of activities authorized by an NRC general license. The inspection involved an examination of your licensed activities as they relate to radiation safety and to compliance with the Commission's regulations and the conditions of the general

- license. The inspection consisted of observations by the inspector, interviews with i personnel, and selective examination of spresentative mcords. The findings of the l inspection were discussed with Mr. Fred M. Gillespie, Jr. and other members of your staff along with Mr. Dwayne Jones of your corporate office at the conclusion of the inspection.

The inspection resulted in the identification of three apparent violations. The violations involved (1) the unauthorized removal of the souire housing from your Lippke System Model MV PM gauges, (2) the failure to leak test your Lippke System Model MV-PM gauges and l your Kay-Ray Model 7062P gauge at the requimd frequency, and (3) the failure to ensure that the label on your Kay-Ray Model 7062P gauge was kept in a legible condition. We are ,

particularly concerned with the issue involving the unauthorized removal of the Lippke l System source housings. The inspection avealed that, on May 19, 1993, workers brought j to the attention of management that the labels affixed to the housing stated that only licensed personnel could remove the source shielding or source containment housing. Management I apparently considered the information provided by the workers and instructed them to remove the housing despite the prohibition on the label. We are concerned that management did not stop the work after the issue was brought to their attention. In your response to the Notice of Violation enclosed with this letter, please also describe your actions to ensure that management is knowledgeable of NRC regulatory nquirements and of the conditions of the genemi license.

4 Appleton Papers, Inc. 2 While we are not aware that similar activities in violation of regulatory requirements have taken place at other Appleton Papers, Inc. locations where radioactive gauges are used, we are concerned that management at those locations may not be sufficiently knowledgeable of regulatory and license requirements to ensure that the requirements are being adhered to.

l During the exit interview, this issue was brought to the attention of Mr. Dwayne Jones of l your corporate office. Under a separate transmittal, we are requesting that your corporate office provide us with a description of the actions that have been taken or will be taken to l ensure that their other facilities are in compliance.

As indicated above, based on the results of this inspection, it appears that your activities were not conducted in full compliance with NRC requirements. A Notice of Violation is enclosed as Appendix A and categorizes each violation by severity level in accordance with

! the " General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (Enforcement Policy). You are required to respond to this letter l and in preparing your response, you should follow the instructions in Appendix A.

Please use the enclosed self-addressed green envelope when you respond to the Notice of Violation in this letter to assist us in the timely processing of your response. In accordance with Section 2.790 of NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and your reply will be placed in the Public Document Room. The responses directed by this letter and the accompanying Notice are not subject to l the clearance procedures of the Office of Management and Budget as required by the l Paperwork Reduction Act of 1980, PL 96-511.
