The purpose of this letter is to inform you that the Commission approved the proposed rule which addresses the relief you sought in the referenced letters. The final rule has been published in 51 Federal

Register 12502 on April 11, 1986.

With the issuance of the new rule and modification of GDC-4 as indicated, staff action on your exemption request has become unnecessary. The final rule states that Applicants for operating licenses seeking to modify design features to take advantage of the rule are required to reflect the revised design in an amendment to the pending FSAR. The staff will then evaluate the design changes.

However, as indicated in the supplementary information accompanying the rule, you should review the PSAR to determine whether the proposed change modifies design criteria set forth in the PSAR, which may require an amendment to the construction permit.
