TOWN OF HAMPTON'S APPLICATION FOR A STAY OF LICENSING BOARD ORDER AUTHORIZING ISSUANCE OF A LICENSE TO CONDUCT LOW POWER OPERATION Town of Hampton (" Petitioner") hereby applies for a stay, pursuant to 10 C.F.R. S2.788,,of the Atomic Safety and Licensing Board's Order of March 25, 1987 authorizing the issuance of an operating license to conduct low-power (up to 5 percent of the rated power) operation. The Appeal Board should grant a stay to preserve the status quo pending a final decision on the appeal of the Licensing Board's Order previously filed by the State of Massachusetts.

In support of this application, the Town of Hampton states that by vote of Town Meeting and by resolution of the Board of Selectmen the Town of Hampton will not implement the New Hampshire Radiological Emergency Response Plan (NHRERP) for the Town in the event of emercj-ency at Seabrook; that the State of Massachusetts and at least six 8704150233 870408 PDR ADOCK 05000443 G PDR ,

other area towns have similarly refused to implement the NHRERP; and Applicant has otherwise failed to provide reasonable assurance that adequate protective measures can and will be taken in the event 4

of radiological emergency. Applicant's request for low power testing, therefore, is grossly premature, unreasonably compromises the public interest and safety in the face of the avowed refusal of area towns to implement NHRERP in the event of an emergency, and will generate substantial and unnecessary clean-up costs in the event Applicant is permitted to irradiate the facility through low power operation' and then is subsequently denied a full power license.

By way of further support for this application, the Town of Hampton relies upon and incorporates by reference herein " Attorney General James Shannon's Application for A Stay of Licensing Board Order Authorizing Issuance of Operating License to Conduct Low Power Operation" dated April 6, 1987 and Exhibits 1 through 5 attached thereto.
