Dear Ms. Garde:

This is in response to your June 9,1986, letter addressing a comment made in my letter dated May 8,1986, regarding-your Freedom of Information Act (F0IA) request, F0IA-86-208, for all records " relevant to and/or generated in connection with any information known to the NRC about potential sabotage at the Comanche Peak nuclear power plant."

In your June 9 letter, you express concern that my letter dated May 8,1986, suggested that "you either specifically identify the source about the incident you recall as being termed potential sabotage, or otherwise provide a reasonable description of requested records as required by the F0IA, 5 U.S.C. 552(a)(3)."

We regret that there has been a misunderstanding about the use of the word

" source" in my May 8 letter. For your information, my use of the word " source" in that statement did not refer to a person. Instead, it referred to any document that may have constituted the " Commission notification" which you referenced in your telephone conversation with David Meyer of my staff. I direct your attention to that portion of my letter dated May 8,1986, commenting on that telephone conversation, which states in part that, "...you stated you

  • , were not referring to terrorist-type sabotage but, rather, an incident which you recalled may have resulted in a Commission notification (emphasis added)...."

Inasmuch as the third paragraph of your letter differs significantly from the stated scope of your previous related request, F01A-86-206, we are treating your June 9 letter as a new F0IA request, F01A-86-435, for all records which contain either sabotage or malicious acts at the Comanche Peak nuclear plant from March 1984 to present. This new request has been assigned to David Meyer, whose telephone number is 492-8978.

In partial response to this new request, F01A-86-435, please note that the three records identified on the enclosed Appendix A are subject to F01A-86-435 and were disclosed under F01A-86-208. We will notify you upon completion of the search and review of records subject to F01A-86-435.
