AMEN 0 MENT TO 10 CFR PARTS 11 AND 25: IMPLEMENTATION OF THE USE OF SF-86, "QUESTIONNAIRE FOR SENSITIVE POSITIONS" r

Enclosed for your signature is a final rule to be published in the Federal Register that amends 10 CFR Part 11. "Criteria and Procedures for Determining  ;

Eligibility for Access to or Control Over Specia,1 Nuclear Material" and '

10 CFR Part 25, "Access Authorization for Licensee Personnel."

Background:

As of September 16, 1988, the Office of Personnel Management (OPM) will accept only the Standard Form (SF) 86, "Questionnaire for Sensitive ,

Positions" which will serve as the basis fo.' the investigation of all individuals ,

who require an NRC personnel security clearan e and/or material access authori-ration. Licensee personnel, licenses contractors, and other persons who require access to classified information must be granted an NRC personnel security r clearance ; and those requiring access to or con /rol over special nuclear material must be granted a material access authorization ty NRC. Therefore, the current regulations,10 CFR Parts 11 and 25 are being amended to reflect changes in form ~

requirements.

,Public Comnents: Because these are amendirents dealing with agency practice  :

and procedure, the notice and connent provisions of the Administrative Procedure Act do not apply pursuant to 5 U.S.C. 533(b)(A). The amendments will be effective 30 days af ter publication.

i Notices: A notice to the Commission that the EDO has signed this rule is ,

enclosed for inclusion in the next Daily Staff Notes (Enclosure C). t Congressional Connittees will not be notified. The Office of Administration  ;

and Resources Management (ARM /DISS) will notify affected licensees and other interested persons of this rulemaking initiative. ,

Coordination: The Division of Freedom of Information and 'ublications Services, Office of Administration and Resources Management concurs 'n these amendments. i The Office of the General Counsel has no legal objections. [
