SUBJECT:
CONTROL OF NRC RULEMAKING By memorandum of February 13, 1984, " Control of NRC Rulemaking by Offices Reporting to the EDO," Offices were directed that effective April 1,1984, (1) all offices under EDO purview must obtain my approval to begin and/or continue a specific rulemaking, (2) resources were not to be expended on rule-makings that have not been approved, and (3) RES would independently review I
rulemaking proposals forwarded for my approval and make reconsnendations to me concerning whether or not and how to proceed with the rulemakings.
In this regard, your February 1,1985 memorandum to me noted that you propose to discontinue the following rulemakings:

" Lower Radiation Exposure Levels for Fertile Women" (Revision of 10 CFR Parts 19 and 20).

" Changes in Radiation Dose Limiting Standards" (Revision of 10 CFR Parts 19 and 20).

" Performance Testing of Bioassay Labs" (Revision of 10 CFR Part 20).

" Severe Accident Design Criteria" (Revision of 10 CFR Part 50).

I agree with your proposal to discontinue these rulemakings. The NRC Regulatory Agenda (NUREG-0936) should be modified to reflect the status of these rulemakings.

CONTROL OF NRC RULEMAKING: TERMINATION OF CERTAIN RULEMAKING ACTIVITIES In conjunction with my review of RES rulemaking activities I, have discovered the following items listed in the regulatory agenda for which no further activ-ity is planned.
I propose these items be dropped from the regulatory agenda.
A 7 1.
" Lower Radiation Exposure Levels for Fertile Women" (Parts 19, 20),

" Changes in Radiation Dose Limiting Standards" (Parts 19, 20).
i Both of these activities have been subsumed in the revision of " Standard of Protection Against Radiation" which is now being considered by the Commission.
q 3.
" Performance Testing of Bioassay Labs" (Part 20).'
The Health Physics Society Standards Committee is preparing a Standard on Per-formance Testing of Bioassay Labs.
This standard is expected to-be completed in about two years.
At that time the performance of Bioassay Labs will be evaluated against the standard.
Based on this evaluation,'a decision will be made whether rulemaking is warranted.
If rulemaking is deemed necessary, the staff will propose to the ED0 that rulemaking be initiated in this area.

"SevereAccidentDesignCriteria"(Part'50).
This activity has been supplanted by the Severe Accident Policy Statement (SECY-84-370) now before the Commission.
