SUBJECT:
CONTROL OF NRC RULEMAKING By memorandum of February 13, 1984, " Control of NRC Rulemaking by Offices Reporting to the EDO," Offices were directed that effective April 1,1984, (1) all offices under EDO purview must obtain my approval to begin and/or continue a specific rulemaking, (2) resources were not to be expended on rule _
makings that have not been approved, and (3) RES would independently review rulemaking proposals forwarded for my approval and make recomendations to me concerning whether or not and how to proceed with the rulemakings.
In this regard, your memorandum of February 28, 1985 concerning a rulemaking that redefines criteria for an extraordinary nuclear occurrence informed me that the rulemaking (recently Commission approved for public comment) should be (1) exempted from the aforementioned review until after coments concerning the rulemaking are addressed, and (2) allowed to continue.
I agree to defer the rulemaking review until after comments are addressed and approve continuation of the rulemaking. The NRC Regulatory Agenda (NUREG-0936) should be modified to reflect the status of this rulemaking.

CONTINUATION OF RULEMAr.ING TO REDEFINE CRITERIA FOR AN EXTRA 0RDINARY NUCLEAR UCCURRENCE (PRM-140-1)
The Secretary to the Comission has recently informed us (memorandum to i
you dated February 21,1985) of the Commission's intent to publish proposed EN0 criteria.
For this reason, the normal independent regulatory review to evaluate whether this rulemaking should be ccptinued will be deferred until after the proposed rule is published and public comments are received and analyzed.
