This refers to the special equipment qualification (EQ) team inspection

conducted at the Waterford Steam Electric Station, Unit 3 during the period of

December 8-12, 1986, onsite and subsequently in the NRC Region IV office until

March 13, 1987. The results of that inspection are reported in NRC Inspection .

Report 50-382/86-32. As Mm James L. Milhoan stated to you during our meeting

on September 1, 1988, we will schedule an enforcement conference in the near

future. The date will be established in a separate letter.

During the EQ team inspection, seven Potential Enforcement / Unresolved Items

and sixteen Open Items were identified. Subsequently, it has been found that

certain of your activities appear to be in violation of NRC requirements

although operability aspect: have now been addressed. At the forthcoming

enforcement conference, you should be prepared to discuss your understanding

of the apparent violations which represent failures to fully establish r

qualification of the equipment identified in the enclosed agenda. The

referenced inspection report was forwarded to you under separate cover.

These discussions should for.us on information related to the November 30,

1985, deadline. for compliance with 10 CFR 50.49 and possible civil penalties i

- applicable to licensees not in compliance with 10 CFR 50.49 as described in

the April 1, 1988, Generic Letter (88-07), Modified Enforcement Polic

Relating to 10 CFR 50.49, "Environment Qualification of Electrical Eq ipment

Important to Safety for Nuclear Power M ants." The NRC is pirticular y i

concerned with the number of fa! lures to establish equipment qualification by l

the November 30, 1985, deadline identified at Wattefctd Unit 3 during the NRC l

inspection. Discussions shoul/ oiso address evaluation of many of these

issues for reportability under 10 CFR 50.72 and 50.73. ,
