Attached is the recently updated list of U.S. Facilities Eligible for IAEA Safeguards.

The list is besed on input provided by both the Nuclear Regulatory Commission and the Department of Energy. The list was approved by the Executive Department and subjected to review by Congress. Under the Agreement between the United States and the Intemational Atomic Energy Agency for the Application of Safeguards in the United States, the U.S.

Govemment is obligated to prepare and update the Eligible Facility List. Pursuant to 10 CFR Part 75.2(b), the Eligible Facilities List shall be available for inspection in the Commission's Public Document Room.

Amending the U.S.

List of Facilities Eligible for International Safeguards Attached for your approval is a memorandum to the Assistant Secretary for Legislative Affairs recommending that she sign letters to the Chairmen and Ranking Minority Members of the House International Relations and Senate Foreign Relations Committees.

1 As the memorandum notes, since the list of U.S.

facilities eligible for lAEA safeguards was last updated, in January 1996, several changes have accumulated.

This submission reflects the decision of Department of Energy j

to designate nine additional facilities as eligible for the application of international safeguards, including the uranium storage area (Building X-345) at Portsmouth Gaseous Diffusion Plant in Ohio.

It also reflects the Nuclear Regulatory Commission's designation of the downblending facility and RTRFE facility at the BWX Technology plant in Lynchburg, VA. The submission of these three facilities will facilitate the i

verification of a significant amount of high enriched uranium deemed excess to the U.S. defense needs.

Furthermore, the addition of the Actinide Packaging and Storage Facility and the K-Area Material Storage Facility at the Savannah River Site in South Carolina will further the U.S.-Russia-IAEA Trilateral Initiative by permitting up to 15 tonnes of excess plutonium to be subject to i

IAEA verification.

These actions continue our implementation of President Clinton's offer of September 27, 1993 to make excess fissile material subject to the U.S.-IAEA Voluntary offer Safeguards Agreement.

Voluntary Offer Safeguards Agreement ISSUE FOR DECISION:

Whether to sign the attached letters informing Congress of the Executive Branch's intention to make appropriate changes to the list of nuclear facilities eligible for International Atomic Energy Agency (IAEA) safeguards pursuant to the U.S.-IAEA Safeguards Agreement.

Since the U.S.-IAEA Safeguards Agreement entered into force in December 1980, the list was last updated in January 1996.

ESSENTIAL FACTORS:

In 1967, the U.S. voluntarily offered to submit all its nuclear activities, " excluding only those facilities associated with activities with direct national security significance," to NPT-type IAEA safeguards.

That offer was subsequently implemented by a U.S.-IAEA Safeguards Agreement, ratified as a treaty, which entered into force on December 9, 1980.

In conjunction with testimony at the 1979 Senate hearings on the U.S.-IAEA Safeguards Agreement, the Senate was provided a list-of all nuclear facilities in the U.S.

judged not to be of direct

-national security sd,nificance.

That same list was subsequently

'provided-to the IAEA as the list of U.S. nuclear facilities eligible for international safeguards.

The list was updated following Congressional notifications in 1986, 1991, July 1994, September 1994, May 1995, and January 1996.

Since that time, two Nuclear Regulatory Commission (NRC) licenced facilities ano nine-Department of Energy (DOE) license exempt facilities have been identified for addition to the list of eligible facilities.

Other deletions and modifications have been proposed.

l L The Interagency IAEA Subgroup (which includes representatives from State, ACDA, DOE, DOD and NRC) has reviewed the list containing-the facilities proposed to be added to the eligible

' list.

The Subgroup has determined that they are not associated with' activities of direct national security significance to the

. United States and that no Restricted Data will be revealed as a result of any IAEA. inspection or related activity at these facilities.

l The new additions include the 1) uranium storage area (building X-345) at the DOE Portsmouth, Ohio Gaseous Diffusion Enrichment Plant, 2) Actinide Packaging and Storage Facility and K-Area Materials Storage Facility at the Savannah River Site, South Carolina, 3) Waste Isolation Pilot Plant at Carlsbad, New Mexico, 4) MTR-603, Materials Test Reactor, Idaho National Engineering Laboratory, Idaho Falls, Idaho, 5) NDA Laboratory.

Building 752, B-wing and Radioactive Scrap and Waste Facility at Argonne National Laboratory-West,_ Idaho Falls, Idaho and, 6)

'Downblending facility and RTRFE facility at BWX Technologies l

plant, Lynchburg, Virginia.

The uranium storage area (Building X-345) at Portsmouth Gaseous Diffusion Plant as well as the downblending facility and RTRFE facility at the BWX Technologies plant contain, or will contain, high enriched uranium deemed excess to the defense needs and scheduled for downblending.

Furthermore, the addition of the facilities at the Savannah River Site will further the U.S.-

Russia-IAEA Trilateral Verification Initiative by permitting up_to 15 tonnes of excess plutonium to be subject to IAEA_verication.

These actions continue our implementation of President Clinton's September 27, 1993 offer to make excess fissile materials subject to the U.S.-IAEA Safeguards Agreement.

In accordance with the understandings on which the Senate gave its consent to ratification of the U.S.-IAEA Safeguards Agreement,

_t is now necessary to notify the Chairmen and Ranking Minority Members of the Senate Foreign Relations and the House Foreign Affairs Committees of the Executive Branch's intention to amend the list of eligible facilities by making the detailed additions.

Letters are attached for your signature.

I am writing to inform you, pursuant to_the understanding incorporated in the Presidential Proclamation of the Ratification of.the Agreement Between the United States of America and the International Atomic Energy Agency'(IASA) for the Application of Safeguards in the United States of America, that the Executive Branch intends'to amend the list of U.S. nuclear facilities identified as eligible for selection by the IAEA for the

-application of safeguards pursuant to that Agreement.

In 1967, President Johnson offered to place U.S. nuclear facilities, except those associated with activities with direct national security significance, under IAEA safeguards in order to demonstrate that the application of those safeguards would not work to any nation's commercial advantage, and thereby to allay concerns expressed by some non-nuclear weapons states regarding adherence to the Treaty on the Nonproliferation of Nuclear Weapons (NPT).

'Following the negotiation and entry into force of NPT-type safeguards agreements between our principal non-nuclear weapons i

state allies and the IAEA, President Carter transmitted the U.S.-

IAEA Safeguards Agreement to the Senate for its advice and consent to_ ratification as a treaty.

Following Senate advice and consent and Presidential ratification, this Agreement entered into force on December 9, 1980.

In considering this matter, the Senate placed five understandings on its consent to ratification.

These include:

That the President shall notify the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives of any proposed addition to the list, to be provided to the International Atomic Energy Agency pursuant to Article 1(b) of the Agreement, of nuclear i

The original list of eligible facilities was reviewed by the Senate in 1979 in connection with hearings on ratification and was provided to the IAEA'upon entry into force of the treaty in December-1980.

This list has been periodically updated, most recently in January 1996.

The list has again been reviewed for updating purposes.

The DOE facilities to be added to the eligible list are identified in the'first enclosure.

In addition, enclosure 2 shows the addition of two NRC licensed facilities and the deletion of-one such facility from the eligible list.

The deleted facility has been decommissioned, thus it is no longer available for selection and application of safeguards by the IAEA.

I would draw your attention to the addition of 1) the uranium hexafluoride and uranium oxide storage areas (Building X-345) at the Portsmouth, Ohio, Gaseous Diffusion Plant as well as the downblending facility and RTRFE facility at the BWX. Technology plant in Lynchburg, Virginia.

In the most recent update to of the eligible facilities list, Congress was notified, on February 9, 1996, of the proposed addition of the Portsmouth and Paducah Gaseous Diffusion Plants.

At that time the Executive Branch noted that the special nuclear materials storage building (Building X-345) at the Portsmouth Gaseous Diffusion Plant would be excluded fromLthe listing because it contained special nuclear materials whose disposition had not been determined.

Since that time, it has been verified that the Building X-345 uranium hexafluoride storage area and uranium. oxide storage' areas contain no material of national security significance.

The February 9, 1996 notification also included select areas of the B&W plant (whose name has since changed to BWX Technology) for the purpose of purifying and downblending HEU the United States obtained from the Kazakhstan Government.

The Executive Branch has now requested

_that the Nuclear Regulatory Commission place the areas at the BWX Technology plant where high' enriched uranium excess to the national security significance is to be handled on the eligible facilities list.

The Executive Branch has: concluded that no Restricted Data will be revealed as a result of any IAEA inspection or related' activities at these facilities.

I would also like to draw your attention to the addition of the Actinide Packaging and Storage Facility and the K-Area

Following the negotiation and entry into force of NPT-type safeguards agreements between our principal non-nuclear weapons state. allies and the IAEA, President Carter transmitted the U.S.-

IAEA Safeguards Agreement to the' Senate for its advice and consent to. ratification as a treaty.

Following Senate advice and consent and Presidential ratification, this Agreement entered into force on December 9, 1980.

In considering this matter, the Senate placed five understandings on its consent to ratification.

These include:

of the House of Representatives of any proposed addition to the list, to be provided to the International Atomic Energy Agency. pursuant to Article 1(b) of the Agreement, of nuclear i

facilities within the United States eligible for International Atomic Energy Agency inspections, together with an explanation of ' the basis upon wh' ch the determination was made that any i

such facility did not have a direct national security

. significance, not less.than 60 days prior to such proposed addition being provided to the International Atomic Energy The' Honorable Lee.H. Hamilton, Committee on International Relations, House'of Representatives.

Agency, during which period the Congress may disapprove such adoition by joint resolution by reason of direct national j

security significance, under procedures identical to those provided for the consideration of resolutions pursuant to section 130 of the Atomic Energy Act of 1954, as amended.

The original list of eligible facilities was reviewed by the Senate in 1979 in connection with hearings on ratification and was provided to the IAEA upon entry into force of the treaty in December 1980.

This list has been periodically updated, most recently in January 1996.

The list has again been reviewed for updating purposes.

The DOE facilities to be added to the eligible list are identified in the first enclosure.

In addition, enclosure 2 shows the addition of two NRC licensed facilities and the deletion of one such facility from the eligible list.

The deleted facility has been decommissioned, thus it is no longer available for selection and application of safeguards by the IAEA.

I would draw your attention to the addition of 1) the uranium hexafluoride and uranium oxide storage areas (Building X-345) at the Portsmouth, Ohio, Gaseous Diffusion Plant as well as the downblending facility and RTRFE facility at the BWX Technology plant in Lynchburg, Virginia.

In the most recent update to of the eligible facilities list, Congress was notified, on February 9, 1996, of the proposed addition of the Portsmouth and Paducah Gaseous Diffusion Plants.

At that time the Executive Branch noted that the special nuclear materials storage building (Building X-I 345) at the Portsmouth Gaseous Diffusion Plant would be excluded from the listing because it contained special nuclear materials whose disposition had not been determined.

Since that time, it has been verified that the Building X-345 uranium hexafluoride storage area and uranium oxide storage areas contain no material of national security significance.

The February 9, 1996 notification also included select areas of the B&W plant (whose name has since changed to BWX Technology) for the purpose of purifying and downblending HEU the United States obtained from the Kazakhstan Government.

The Executive Branch has now requested that the Nuclear Regulatory Commission place the areas at the BWX Technology plant where high enriched uranium excess to the national security significance is to be handled on the eligible facilities list.

The Executive Branch has concluded that no Restricted Data will be revealed as a result of any IAEA inspection or related activities at these facilities.

I would also like to draw your attention to the addition of the Actinide Packaging and Storage Facility and the K-Area Material Storage Facility at the Savannah River Site in South Carolina.

The addition of these facilities will further the U.S.-

Russia-IAEA Trilateral Verification Initiative by permitting up to 15 tonnes of excess plutonium to be subject to IAEA verification.

These actions continue our implementation of President Clinton's offer of September 27, 1993, to subject excess fissile materials to our voluntary offer safeguards agreement with the IAEA.

Through the addition of these facilities, the U.S. will set an example for other countries and thus further the cause of nonproliferation and disarmament.
