Dear Dr. Koch:

Thank you for your letter of April 4,1986 addressed to Chairman Palladino, describing the recent tests at EBR-II demonstrating the inherent reactor shutdown and decay heat removal characteristics of that design.

The NRC staff is aware of the testing at EBR-II and will make appropriate use of the

'information provided by the EBR-II test program.

I am sure that these tests will contribute significantly to the evaluation of the performance capabili-ties of advanced liquid metal reactors.

It may interest you to know that there is presently consideration of developing performance-based regulations, for which tests, such as those recently performed in EBR-II, could serve as a basis.

The Commission's proposed policy on advanced reactors encourages a performance-based approach to the licensing of advanced reactors.

The staff has, in fact, recently received a request from a major reactor vendor to consider a rulemaking to allow certification of a reactor design by test.

Thank you again for your letter sharing your observations on the EBR-II tests.
