WAIVER OF CRGR REVIEW OF CENPD-289-P SAFETY EVALUATION (TAC NO. M87910)

Attached is the safety evaluation (SE) report prepared by the Office of Nuclear Reactor Regulation (NRR), in which the staff accepts the Topical Report CENPD-289-P of ABB Combustion Engineering (ABB-CE) for referencing in license applications. The staff proposes that the Committee To Review Generic Requirements (CRGR) review be waived in accordance with the procedures in the memorandum referenced above.

l CENPD-289-P describes a new fuel mechanical design for the fuel assembly that uses solid inert replacement rods of stainless steel to replace failed or damaged fuel rods of ABB-CE fuel l assemblies. The reconstitution method described in CENPD-289-P is consistent with the staff l position in Generic Letter 90-02, Supplement 1. The reconstitution intends to facilitate a

licensee's reload core design. The staff has approved similar reconstitution methods for other fuel vendors. The subject report does not present any new methodology, nor does it require any new staff technical position; it merely presents another application of an existing and approved methodology.

According to the CRGR charter, CRGR should review all of the staff's approvals of topical reports. However, we believe that CRGR review is not necessary because the staff approval of the ABB-CE Topical Report CENPD-289-P does not represent a new position by the staff. If you agree that a CRGR review is not necessary, please so indicate by signing below.

Otherwise, we will prepare an appropriate CRGR package.
