Proprietary Information In a letter dated July 11, 1986, you submitted the General Elect'ic report

" Probability of Missile Generation in General Electric Nuclear Turbines" in ful-fillment of a license condition contained in the Hope Creek low-power license.

In your letter you requested that this report be withheld from public disclosure pursuant to 10 CFR 2.790.

Your letter does not provide the necessary basis required by 10 CFR 2.790 for withholding the subject report. Generally, 10 CFR 2.790 requires that a person who proposes that a document, or part of a document, be withheld from public disclosure on the grounds that it contains trade secrets, privileged, confidential, commercial or financial information, shall submit an application for withholding, accompanied by an affidavit which:

(1) identifies the document or part sought to be withheld and the position of the person making the affidavit, and (2) contains a full statement of the reasons and bases on which the withholding is claimed.

The affidavit must be executed by the owner of the information even though the information sought to be withheld is submitted to the Coninission by a third party (PSEAG, for example).

10 CFR 2.790 states that the Commission shall determine whether information sought to be withheld from public disclosure is a trade secret or confidential or privileged connercial or financial information and, if so, should be withheld.

The following will be considered in making this determination:

(1) whether the information has been held in confidence by its owner; (2) whether the information is of a type customarily held in confidence by its owner; 8608180435 860811 PDR ADOCK 05000354 P PDR

-2 (3) whether the information was transmitted to and received by the Comission in confidence; (4) whether the information is available from public sources; and (5) whether public disclosure of the information sought to be withheld is likely to cause substantial harm to the competitive position of the owner of the information, taking into account the value of the infonnation to the owner; the amount of effort or money, if any, expended by the owner in developing the information; and the ease or difficulty with which the information could be properly acquired or duplicated by others.

We request that you prepare and submit an application (with affidavit) for with-holding the subject report.

In not less than thirty (30) days from the date of this letter, the subject report will be placed in the Public Document Rooms, unless this application for withholding is submitted. On receipt of your application, your request for with-holding will be considered in light of application statutes and regulations and a determination will be made whether the documents will be withheld from the Public Document Rooms.
