a ENCLF,5URE 1 NOTICE OF VIOLATION Westinghouse Electric Corporation Docket No. 70-1151 Nuclear Fuel Division Facility License No. SNM-1107  :

During the Nuclear Regulatory Connission (NRC) inspection conducted on I l August 29 - September 2, 1988, violations of NRC requirements were identified. t 4 In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are listed below:

A. 10 CFR 20.20!(e) requires that each area or room in which licensed material is used or stored and which contains any radioactive material in  :

j Chapter 3. Section 3.2.1.1 of the licensee's application for License j No. SNM-1107 requires that written procedures describing general radiation  :

I Health Physics Operation Procedure 05-015, "Abandonment or Disposition of I Material or Equipment," Revision 7. requires that contaminated items which (

need to be removed from the Contamination Controlled Area (CCA) for the purpose of storage on the plant site shall comply with specified surface contamination limits. Alternately, they may be bagged out and taped to [

prevent dispersion of radioactive materials. -

r j Contrary to the above, the licensee failed to follow procedures in that on l August 31, 1988, equipment removed from the CCA and stored in trailers on  ;

the plant site was found to exceed the specified contamination limits and  ;

was neither bagged nor taped to prevent dispersion of radioactive i

Westinghouse Electric Corporation Docket No. 70-1151 Nuclear Fuel Division Facility 2 License No. SNM-1107 C. License Condition No. 9 of Special Nuclear Material (SNM) License No. 1107 requires that licensed material be used in accordance with statements, representations, and conditions contained in Chapters 2, 3, and 4 of the application dated March 26, 1984, and supplements thereof.

Chapter 3, Section 3.2.5.1 of the licensee's application requires that contamination surveys be performed on a continuing basis to evaluate the potential spread of radioactive contamination, and specifies a minimum survey frequency of weekly for controlled areas.

Contrary to the above, contamination surveys were not performed on a weekly frequency in the expansion decontamination area prior to August 29, 1988.

This is a Severity Level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, Westinghouse Electric Corporation '

is hereby required to submit a written statement or explanation to the Nuclear Regulatory Ccruission, ATTH: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II within 30 days of the date of the letter transnitting this Notice. This reply should be clearly marked as a "Reply to a Notice of Violation" and should include (for each violation):

(1) admission or denial of the violation, (2) the reason for the violation if admitted. (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good CaJse is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
