APPENDIX A NOTICE OF VIOLATION Omaha Public Power District Docket:

50-285 Fort Calhoun Station Operating License:

DPR-40 During an NRC inspection conducted on September 12-16, 1988, violations of NRC requirements were identified.

The violations involved failure to identify pressure boundary parts as safety-related in a design package, failure to accurately reference the design basis in a purchase order, and failure to have adequate certification for safety-related components. -In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are listed below:

A.

Criterion !!! of Appendix B to 10 CFR Part 50 and the licensee's approved quality assurance program description require that measures shall be established for the selection and review for suitability of applica' ion of parts and equipment that are essential to the safety-related functions of the structures, systems, and components.

Critical Quality Elements (CQE) List, Revision 3, dated March 13, 1987, Part 1.II.B.5.a requires that each part in an krerican Society of Mechanical Engineers component be considered COE (i.e., safety-related) if its failure would result in the corrponent failure.

Contrary to the above, Section 11.1, a materials listing in the final revision of Design Package 84-176, did not identify valve (LCV-101-1) pressure boundary parts (Items 4 and 8, body-to-bonnet nuts and studs) to be CQE.

This is a Severity Level IV violation.

B.

Criterion IV of Appendix B to 10 CFR Part 50 and the licensee's approved quality assurance program description require that measures shall be established to assure that design bases are suitably included or referenced in procurement documents.

The Quality Assurance Plan, Revision 13, dated August 1, 1988, paragraph 4.1.1 requires that design bases be included in documents for procurement of COE items.

Contrary to the above, Purchase Order 35933 to Conax for a resistance temperature detector did not include all of the seismic floor response spectra contained in the design package for Modification 87-016; i.e., the operating basis earthquake floor response spectra was not made a i

requirerent of the procurement document text.

This is a Severity Level V violation.

Part 2.II.5.2.2 of the CQE List, Revision 3, dated March 13,he1987, requires that new CQE components be purchased qualified to t requirements of the Institute of Electrical and Electronic Engineers (IEEE)-323 and -344 standards.

Contrary to the above, Section 11.5 of the final revision of Design Package 86-046 dated August 11, 1988, identified that certain stored items, namely, a terminal block (631-8521) bought on Purchase Order 50707

and a fuse block (631-0858) bought on Purchase Order 72648, were to be used for which there is no certification of their qualification to IEEE-323 and IEEE-344 requirements on file.

This is a Severity Level IV violation.

hereby required to submit to this office, within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation:

(1) the reason for the violation if admitted.

(2) the corrective steps which have been taken and the results achieved, (3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown,
