Dear Mr. Chairman:

In esponse to your it tter of September 14, 1988, I would like to inform the Subcomittee that the NRC staff completed its review of those portions of the Office of Investigations report addressing fitness-for-duty issues concerning a unior managei* at the Davis-Besse plant and the licensee's investigation of thosa issues. On September 23, 1988, the staff forwarded its recoinndation on appropriate enforcement act:on for the Comission's cMsiderat.on. The Comission has now reached a 'inal decision on this matter and has approved the attached letter from A. Bert Davit, Regional Administrator, NRC 3egion III, to the Toledo Edison Company.

With respect to the status of tile Department of Justice's review of the investig'. tion report, the Director of 0! was informed by letter dated September 12, 1988, that the Department has declined prosecution of this Case.
