s]o ONITED STATES NUCLEAR REGULATORY COMMISSION m

7 W ASHINGTON. D. C. 20555

.)[..

October 13, 1988 CHAIRMAN The Honorable John F. Kerry United States Senate Washington. 0.C.

20510 Dea.- Senator Kerry:

I am responding to your recent letters concerning the restart of the Pilgrim Plant.

I am pleased to confirm your October 12, 1988 reouest to address the Comission at its scheduled meeting on Frid'y, October 14, 1988. The Comission has allotted time for your personal appearance at the beginning of that meeting, following the appearance of Senator Kennedy.

The meeting will begin at 2:00 p.m. in our teeting room on the lobby level at One White Flint North.

Your letter of September 29, 1988, concerned the results of a recent NRC Integrated Assessrent Team Inspection (IATI), the results of the recent systematic assessment of licensee perfonnance (SALP), the current status of emergency planning at the Pilgtim Nuclear Power Station, and the adequacy of the Pilgrim Mark I containment. The IATI was perfonned by the NRC staff in conjunction with an augmented inspection program that has been in progress since the facility was shut down in April 1966.

The IATI was one part of the NRC staff's extensive and ongoing effort to monitor Boston Edison Company's (BEco's) prcgram improvements.

The inspection was perforred independently to measure the effectiveness of the licensee's management controls, programs, and perscnnel to support restart of the facility. The findings of the inspection are documented in Inspection Report No. 50/293/88-21, oated September 7, 1988.

However, development of an NRC staff recomendation regarding plant restart involves consideration of the results cf all inspection and review activities, including the IAT!, the ongoing augmented inspection program, and the recent SALP.

(The IATI and SALP reports have been provided to your office.) The concerns you raiso relating to equipment and management have been dealt with as noted ir. these reports.

With respect to your coment on the recent SALP, followup to determina the status of licensee actions and improvements in the Radiological Controls area is detailed in the IATI repart.

The NRC staff has determintd that the radiological controls program at Pilgrim is showing significant irprovement since the SALP report and is continuing to receive high management priority and allocation of resources by the licensee.

The issues related to the Pilgrim Mark I containment have been addressed in detail in the August 21, 1987 response to the 10 CFR 2.206 petition filed by Massachusetts State Senator killiam B. Golden and others. The NRC has concluded that the Pilgrim Mark I containment is adequate t) protect public health and safety and Bcston Edison has voluntarily implerunted containment improvements at Pilgrim that go beycnd current regulatory requirements.

CORMSPONDENCE PDC

The' Honorable John F. Kerry

  • Regarding emergency planning, Boston Edison has been working closely with local officials and the Connonwealth of Massachusetts to correct the i

deficiencies identified by the Federal Emergency Management Agency (FEMA) in its self-initiated review. The status of this effort, as well as the IATI and SALP results, will be discussed during our October 14, 1988 meeting to consider the str.ff's evaluations and reconnendations concerning the restart of Pilgrim.

Your views, as well as those of others, will be ;onsidered in our restart l

decision.

I We will base our restart decision upon the judgment of the adequacy of the l

plant improvements, management, off-site emergency planning improver, ents, and upon our overall judgment whether the Pilgrim plant can and will be operated safely.

I Sincerely, (A/,

Lando W. Zecl, 1Jr.
