Withdrawal of Request for Exemption from 10 CFR 70.24, Criticality Accident  !

Requirements Gentlemen:

This letter documents withdrawal of a previously submitted request for exemption from the requirements of 10 CFR 70.24.

In Reference (b), Maine Yankee requested an exemption from the criticality accident requirements  ;

of 10 CFR 70.24. Since then, Maine Yankee has permanently shutdown the reactor and removed any remaining unirradiated fuel from the site. All remaining fuel is stored beneath water shielding /[

in racks designed to maintain the fuel more the 5%Ak/k subcritical. The inventory of the non-fuel /u special nuclear material is less than 450 grams. Administrative controls have been established to monitor the quantity of non-fuel special nuclear material on-site. Therefore, since 10 CFR 70.24 requires criticality accident monitoring for licensees which possess greater than 450 grams of combined special nuclear material and since 10 CFR 70.24 does not require underwater monitoring when special neclear material is handled or stored beneath water shielding, Maine Yankee believes .

that it is in compliance with 10 CFR 70.24 without the maintenance of a monitoring system.

Accordingly, we hereby withdraw our request for exemption from 10 CFR 70.24.
