Special Report Gentlemen:

In accordance with Nine Mile Point Unit 1 (NMP1) Technical Specification (TS) 6.9.3.f, Niagara Mohawk Power Corporation (NMPC) submits the enclosed Special Report for the last completed Secondary Containment Leak Rate Test. This Special Report and the results of other Secondary Containment Leak Rate Tests conducted after August 28,1979 have not been submitted due to an oversight by NMPC. However, actual testing has confirmed that TS Secondary Containment Leakage requirements were satisfactorily met.

On June 29,1995, a Deviation Event Report (DER), in accardance with NMPC's Corrective Action Program, was initiated by a NMP1 System Engineer which identified this missed TS reporting requirement. The DER was dispositioned by an NMP1 operations support staff member indicating that a Special Report was not required based upon interpretation of the 1

NMP1 TSs, Regulatory Guide 1.16, " Reporting of Operating Information - Appendix A Technical Specifications," and the reporting requirements of 10CFR50.72 and 10CFR50.73.

As a result of an NRC corrective action inspection, NMPC has reviewed the disposition and has concluded that the DER disposition was incorrect. Consequently, NMPC did not recognize the need to submit a Special Report as required by TS 6.9.3.f. Actions have been taken to assure that NMP1 will report Secondary Containment Leak Rate Test results within 3 months of performing the test as required by TS 6.9.3.f.

2.0 PROCEDURE

This test was performed according to surveillance procedure N1-ST-C5, Revision 13 on file at the facility.

2.1 The Reactor Building is isolated by tripping the normal ventilation. With one emergency ventilation system locked out, the alternate emergency system is

automatically initiated.

J 2.2 Emergency vent flow versus reactor building to atmosphere differential pressure were determined alternately for each emergency system operating independently.

2 4.0 SPECIFICATION Figure 3.4.1 of the Technical Specification represents the allowable limit. The differential pressure between the Reactor Building and the external static pressure shall be at least as negative as shown in Figure 3.4.1 for the test condition wind speed and an emergency ventilation fan flow rate less than 1600 cfm.

5.0 EVALUATION This test shows the Reactor Building (secondary containment) leakage to be within allowable limits.
