ORANGE COUNTY'S SECOND MOTION FOR EXTENSION OF TIME TO FILE PROPOSED PROTECTIVE ORDER By order dated March 4,1999, the Licensing Board granted a motion by Orange County to extend until March 19 the deadline for filing a proposed protective order covering Enclosure 6, a proprietary portion of Carolina Power & Light's ("CP&L's") license amendment application.

That extension was requested due to the illness of Orange County's counsel. Orange County hereby requests an additional extension of a week's time, until March 26, in which to file a proposed protective order. This motion is supported by CP&L, and is not opposed by the NRC

' Staff.

Counsel for both parties have worked together diligently to draft a confidentiality agreement and nondisclosure declaration, final drafts of which are now being reviewed by the

Orange County Board of Commissioners Counsel for Orange County anticipates that an additional week is needed in order to pennit sufficient time for the Commissioners to complete their review and finalize the agreement, for signing copies of the nondisclosure declaration and distribution of Enclosure 6 to Orange County's attomey and expert, for review by the attorney and expert c f whether it is necessary to rely on Enclosure 6 in their contentions, and for i

preparatlon of any necessary protective order. Counsel anticipates that agreement with CP&L i
