t MAR I 61999 ALL AGREEMENT AND NON-AGREEMENT STATES OTHER INFORMATION: PUBLICATION OF THE PROPOSED OHIO AGREEMENT (SP-99-013)

Former Governor George Voinovich, on behalf of the State of Ohio, requested that the Nuclear Regulatory Commission (NRC) enter into an Agreement with the Commonwealth pursuant to Section 274 of the Atomic Energy Act of 1954, as amended. Under the Agreement, Ohio would assume regulatory responsibility for byproduct material as defined in Section 11e.(1) of the Act, byproduct material as defined in Section 11e.(2) of the Act, source material, and special nuclear materialin quantities not sufficient to form a critical mass. The State also requests authority to regulate the disposal of low-level radioactive waste received from others, and to conduct the evaluation of safety information on sealed sources and devices.

A notice of the proposed Agreement was published in the Federal Begister on March 11,1999, as required by the Act. The notice also contains a summary of the NRC staff assessment of the Ohio program. The full staff assessment may be viewed in the document SECY-99-039 on the NRC website at http://www.nrc. gov /NRC/ COMMISSION /SECYS/index.html.
