Dear Chainvoman Jackson,

Please find the three enclosed Resolutions adopted by the Township of Essex. Resolution No. 2-99 may be of particular concem to you and your agency. As you may know Commonwealth Edison Company is planning to sell their remaining excess property in the Essex area soon. De sale of this property is ofgreat concem to the Township and the Village of Essex as it is the heart and key to the drainage system of our area. There is also concern that the sale of these properties may present a risk to the health and safety of the residents of our area in respect to an existing landfill and loss of emergency cooling water for the Braidwood Power Station. %ese properties are located in sections 5-6-7. and 8 in the Township of Essex, Kankakee County, Illinois. %cy contain several lakes that have been used by Commonwealth Edison for emergency cooling water for their Braidwood StationNuclear Facility. %e transfer of ownership of these prope: ties to a private concem may eliminate the availability of this water for emergency cooling at the Braidwood Nuclear Facility. Commonwealth Edison has needed the water contained by the lakes on these properties in the past and there is little doubt they may be needed in the future for the safe operation of the BraidwoodNuclear Facility.

Dese concerns have been voiced to Commonwealth Edison officials on several occasions. Although we have been assured by Commonwealth Edison that these are legitimate concems that they will address they have not responded.

i TOWNSHIP OFESSEX, ILLINOIS RESOLUTIONNO. 99-3 WHEREAS Commonwealth Edison Company, a division of UNICOM, is advertising the sale of certam properties in Essex Township and the Village of Essex, Illinois and WHEREAS,the properties are a makr component of an intricate and delicate drainage system that greatly affects the Township of Essex and the surrounding area and WHEREAS Peabody Coal Company created this drainage system in response to local flooding problems that were a result of mining practaces that disrupted the natural drainage patterns and WHEREAS Commonwealth Edison Company purchased this property from Peabody Coal Company knowing of the drainage system contained therein and WHEREAS Commonwealth edison has aminatained this drainage system each year from the date of pur-hase to the present and WHEREAS any disruption of this drainage system will result in severe flooding to the Township of Essex and surrounding areas in the path of Crane Creek and Granary Creek and WHEREAS the citizens and the Board of Trustees of the Township of Essex, Illinois believe that Commonwealth Edison has a responsibility to continue to maintain this drainage system and WHEREAS these concerns have been voiced to Commonwealth Edison officials months ago and have not received any satisfaction and THEREFORE BE IT RESOLVED BY ME TOWNSHIP OF ESSEX, ILLINOIS THAT FOR THE FUTURE HEALTH AND SAFETY OF THE RESIDENTS OF ESSEX AND SURROUNDING AREAS THAT COMMONWEALTH EDISON COMPANY BE REQUIRED TO MAINTAIN THIS PROPERTY AS PART OF ITS BRAIDWOOD NUCLEAR STATION PROPERTY.
