MOTION FOR EXTENSION OF TIME (FOR 2.764(f) REVIEW)
Now come the Conservation Council of North Carolina, Wells Eddleman pro se, and the Joint Intervenors with a request for a thirty-day extension of time in which to file comments to the Commission in its 2.764(f) "immediate effectiveness" review of the Final Licensing Board Decision in the above-captioned docket. In support of the motion are the following:
1.
The Licensing Board in its Final Decision presented three factors which would support an extension of time, those being "(1) fuel loading for Shearon Harris has not begun, (2) operations above low power may be several months away, and (3) [the Board's] decisions in the i
aggregate are lengthy and complex."
LBP-86-11, p. 188 - 189.
2.
Intervenors filed a nctice of appeal on the Final Decision on May 7, 1986, and will file their brief in thirty days. Contrary to the Final Decision at page 185, all matters are not resolved as a late-filed 12 contention was submitted on April 29, 1986.
