This is in response to that portion of your January 31, 1986, letter which requested pennission to implement an annual inventory frequency as permitted under the provision: of 10 CFR 74.31 and your February 11, 1986, request for a 60-day extension in starting the first low enriched uranium physical inventory for 1986.

Inasmuch as you are currently committed to an inventory frequency of twice every calendar year in your approved Transitional Facility Attachment to the Protocol of the US/IAEA Safeguards Agreement, we cannot grant your request to implement an annual inventory frequency under the provisions of 10 CFR 74.31.

This issue is to be discussed with the IAEA during special negotiating sessions later this year. We anticipate that the IAEA will agree to allow an annual inventory frequency for all low enriched uranium facilities in the United States that are under international safeguards. If the IAEA agrees to an annual inventory frequency, your request can be recensidered at a later date.

Accordingly, your request for an annual inventory frequency is hereby denied.

We have reviewed your February 11 request for a 60-day extension and have determined that granting it will not adversely affect the common defense and security nor the public health and safety and is otherwise in the public interest. Accordingly, we are issuing a new unnumbered license condition to Amendment MPP-2 to your License No. SNM-1168, effective immediately, to read as follows:

Notwithstanding the requirements of 10 CFR 70.51(e)(3)(ii) and Section 5.1.2 of the Plan identified in License Condition 2.1 to conduct physical inventories of low enriched uranium at 6 calendar-month intervals, the licensee may start the inventory scheduled for March 10, 1986, on or before May 9, 1986.
