The inspector met with the licensee representatives identified in Paragraph 1 during the inspection and reviewed the scope and findings of the inspection.

No written material was provided to the licensee during the inspection.

81310 Physical Protection for the Transportation of Irradiated Reactor Fuel.

The inspection was conducted by reviewing the documents listed below and by interYieWing licensee personnel.

Spent fuel shipment notification procedures; Procedures established to provide for shipment escorts by private j

contractor and off duty LLEA personnel as-shipment escorts; Instructions provided shipment escorts; l

Procedures provided for the established communication center; and, Logs maintained by escorts and the communication center for selected shipments.

The inspector found that between January 1984 and January 1985, Transnuclear Inc. made 23 shipments of spent fuel using Port Elizabeth, New Jersey as a port of call. Neither the State of New Jersey nor the NRC Region I office were notified of these shipments.

10 CFR 73.37 (f) requires the governor or the governor's designee to be 4

notified in writing prior to the transport of spent fuel within or through a state, and 10 CFR 73.72 (b) and 10 CFR 73.72 (c) requires the appropriate NRC Regional Office to be notified in advance of spent. fuel shipments within the Region.

This'is a violation (86-01-01).
