APPENDIX A NOTICE OF VIOLATION Transnuclear Incorporated Docket No.

70-2478 White Plains, New York As a result of the inspection conducted on March 7, 1986, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following violation was identified:

10 CFR 73.37 (f) states, " Prior to the transport of spent fuel within or through a state, a licensee subject to this section shall notify the governor's designee....."

10 CFR 73.37 (b) (1) states, " Provide for notification of the Nuclear Regulatory Commission in advance of each shipment, in accordance with 73.72 of this part."

10 CFR 73.72 states, "Each licensee who plans to import, export, transport, deliver to a carrier for transport in a single shipment, or take delivery, at the point where it is delivered to a carrier... shall notify the Administrator of the appropriate Nuclear Regulatory Commission Regioial Office listed in Appendix A by U.S. Mail, postmarked at least 7 days in advance of the shipping date....."

Contrary to the above, between January 1984 and January 1985, there were 23 spent fuel shipments made using Port Elizabeth, New Jersey as a port of call and neither the governor's designee of the State of New Jersey nor the NRC Region I office were notified.

This is a Severity Level IV violation (Supplement III).

Pursuant to the provisions of 10 CFR 2.201, Transnuclear Incorporated is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
