5 NOTICE OF VIOLATION Scientific Measurement Systems, Inc. License No. Texas 6-2696 As a result of the inspection conducted on July 28-29, 1986, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violation was identified:
10 CFR 71.12(a)(c)(1)(3) requires each licensee who transports Type B quantities of licensed material in NRC approved containers to register in writing with the Director, Office of Nuclear Safety and Safeguards, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, as a user of the NRC approved containers.
Contrary to this requirement, the licensee failed to register in writing with the Commission as a user of a container approved by the NRC used to transoort Type B quantities of cobalt-60 to a facility located in Defiance, Ohio on July 15, 1986.
This is a Severity Level IV violation (Supplement V).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the -asults achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
