Dear Ms. Evans:
This is in further response to your letter dated April 11, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), six categories of records regarding plants that have been issued an operating license (0L) since the occurrence of the accident at the Three Mile Island (TMI) site in March 1979.
Because of the broao nature of category three of your request and because the staff was unsure about the correct interpretation of the scope of this category, Nina Toms, Jim Holloway, and Roger Mattson held a telephone conversation in your absence on June 17, 1986. On your behalf, Mr. Mattson agreed the following would be responsive to category three of your request:
The staff will provide records that contain data which represent, only the hours expended by the program offices that are subject to licensing fees; they do not represent total hours expended for each plant and are not available on a calendar or fiscal year basis.
Enclosed Appendix F is a list of those cases for which records subject to revised category three of your request are being provided. These records are being placed in the NRC's Public Document Room (PDR) in file folder F01A-86-278 under your name. Enclosed Appendix G is a listing of records subject to category four of your request, which the NRC has already made available for public inspection and copying at the PDR.
The staff has provided the following comments regarding category three. The records being provided to you represent the most current data available, which are categorized by the five offices referenced in your letter. For '
initial licenses issued prior to June 20, 1984, the effective date of the last revision to 10 CFR 170, the licensing fees are computed based on the costs expended from construction permit issuance to the issuance of the full power (100%) license with a maximum ceiling of $1,024,500. For initial licenses issued on or after June 20, 1984, licensing fees are based on the costs expended during a six-month cycle; i.e., June 23 through December 22 and December 23 through June 22 of each year up to the issuance of the full power license. The maximum licensing fee assessed for an OL issued on or after June 20, 1984, is $3,077,400. Further, cost data have not' teeen provided for Diablo Canyon 1 and Monticello. The Lice.ise Fee Management staff of the NRC does not yet have the finalized data for Diablo Canyon 1. With respect to Monticello, no professional staff hour data are available. The initic1.0L was issued prior to March 23, 1978. At that time, the OL fee assessed was a flat fee rather than one based on the professional staff hours expended to conduct the review.
