Dear Mr. Iresident:

Pursuant to Subtitle E of the small Business Regulatory Enforcement Fairnese Act of 1996, 5 U.S.C.

801, the Nuclear Regulatory Commission (NRC) is submitting a final rule that will amend regu]ations to add a provision that provides a method for small entities to contact the NRC for assistance in interpreting or complying with regulatcry requirements.

This action establishes a toll-free telephone number to help small entities obtain information quickly.

The final rule is necessary to comply with the Small Business Regulatory Enforcement Act of 1996.

We have determined that this rule is not a " major rule" as defined in 5 U.S.C. 804(2).

We have confirmed this determination with the Office of Management end Budget.

Er. closed is a copy of the final rule, which is being transmitted to the Federal Register for publication.

This final rule is scheduled to become effective on the date of publication in the Federal Register.

The NRC has sent to the office of the Federal Register for publication the enclosed fina amendment to the Commission's rules in 10 CFR part 2.

The regulations are amended to provide that percons requesting a hearing in certain materials license proceedings must file their requests within 30 days of receiving actual notice of the pendency of the license application, or, if the person does not learn about the application until it has been a

granted, within 30 days of receiving actual notice of the grant of the application.

Informal Small Entity Guidance The NRC is required to answer inquiries from small entities concerning information on, advice about, and compliance with the statutes and regulations that affect them. The NRC is expected to int:rpret and apply the law, or regulations implementing the law, to specific sets of facts that are specified by the small entity. The NRC is required to establish a program to receive and respond to these types ofinquiries. To help small entities obtain information quickly, the NRC has established a toll-free telephone number at 1-800-368-5641 D/'
