OYSTER CREEK NUCLEAR GENERATING STATION - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE

Dear Mr. Roche:

By letter dated October 29,1997, GPU Nuclear Inc. submitted to the NRC a Response to Request for information. This response contained a redacted version of the results of a GPU investigation involving lack of attention in the Oyster Creek control room and a "Redaction identification Key." Your letter and accompanying offidavit signed by Sander Levin, Director, Operations & Maintenance OC, requests that the "Redaction Identification Key" be withheld pursuant to 10 CFR 2.790(6) because it contains information "the disclosure of which would constitute a claarly unwarranted invasion of personal privacy."

c We have reviewed GPU's request based on the requirements and criteria of 10 CFR 2.790, and have determined that the submitted information sought to be withheld contains privacy information. Therefore, the privacy information so identified by GPU will be withheld from public disclosure pursuant to 10 CFR 2.790(a)(6) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

If the basis for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, such as, if the scopa of a Freedom of Information Act request includes your information, if the NRC determines that the information should be made publicly available as a result of future review, you will be notified in advance of any public disclosure.
