INSPECTION REPORT 70-0036/98 201 AND NOTICE OF VIOLATION

Dear Dr. Kaiser:

l This refers to the Nuclear Criticality Safety (NCS) inspection by members of the Headquarters i

staff conducted on January 12 - 16,1998, at your facility in Hematite, MO. The purpose of this inspection was to determine whether activities authorized by your license were conducted safely and in accordance with NRC requirements. At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the report.

Areas examined in the inspection are identified in the enclosed report. Within these areas, the inspection consisted of selective examination of relevant records, interviews with plant personnel, and observation of activities in progrt ts. Within the scope of this inspection, one cited and two non-cited violations were identified, as well as two unresolved items. Seven of nine previously opened inspector followup items were closed, and one was recategorized as a violation.

You are required to respond to the enclosed Notice of Violation and should follow the instructions specified in the enclosed Notice when preparing your response, in your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to this Notice, including your proposed correctivo actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
