2 Commissioner Dieus' comments on SECY 97 288:
I do not approve the staffs draft of NRC's Annual Report to Congress for FY 97 regarding abnormal occurrences.
During FY 97 there occurred events involving the loss of control of liennsed materials resulting in their entering the public domain in an uncontrolled manner causing radioactive contamination or radiation exposures. In some cases, the incidents received media coverage, in at least one case, NRC's oversight of the licensed material was the subject of correspondence exchanpd between the NRC and a State health agency. Loss of control of licensed sources is emerging as a significant matter of concern (see, for example, SECY 97 273). In my view, events such as these merit inclusion in the report to Congress under Appendix C, 'Other Events of Interest
- because they 'may possibly be perceived by the public to be of health and safety significance.'
Attached is a list of five examples of such events that occurred in FY 97. This should not be taken as an inclusive list.
Staff should review the event data base for FY 97 for other events that may be candidates for inclusion in the report as Appendix C items, reviso the draft report as needed and resubmit the draft report to the Commission for approval. For this and future reports, in its paper staff should identify the cases that were considered es candidates for inclusion as Appendix C items and briefly discuss the merits of including them in the report.
