SAFETY EVALUATION REPORT: APPLICATION DATED AUGUST 17,1998, LICENSE EXTENSION (TAC NO. L31081)

BACKGROUND By application dated August 17,1998, Pennsylvania State University (PSU) requested that the

expiration date for Materials License SNM-95 be extended for five years in accordance with 4

10 CFR 70.38(a)(2).

DISCUSSION PSU has requested a five year extension to their license expiration date in accordance with 10 CFR 70.38(a)(2) which allows a five year extension of the expiration date provided the licensee meets the requirements of 10 CFR 70.38(a)(2).10 CFR 70.38(a)(2) states that the licensee must meet the requirements of 70.38(a)(3). The staff has reviewed PSU's license to determine if it meets the requirements of 10 CFR 70.38(a)(3) and has determined that it meets the requirements as discussed below:

70.38(a)(3)(i) states that an evaluation, or an emergency plan, must not be required in accordance with 10 CFR 70.22(i). PSU is not required to have an emergency plan because the licensee is exempted from the requirement for a criticality monitoring

70.38(a)(3)(ii) states that the licensee must have received W 'tten notice from the NRC l

that their certification of financial assurance for decommissioning is acceptable. On l

July 26,1990, the licensee submitted a consolidated decommissioning plan. On March i

27.,1991, a Standby Trust Agreement, a Letter of Credit, and a Certificate of l

Incumbency were submitted to NRC. On October 28,1991, NRC concluded that the submitted information met NRC requirements and, therefore, approved the plan; 3.

70.38(a)(3)(iii) states that the licensee must not be listed in the Site Decommissioning l

Management Plan List published in NUREG-1444, Supplement 1 (November 1995).

PSU is not listed on this Site Decommissioning Management Plan List; 4.

70.38(a)(3)(iv) states that the renewal of the license must meet the categorical exclusion requirements of 10 CFR 51.22(c)(14), and that, neither an environmental assessment nor environmentalimpact statement be required. PSU meets this requirement; 1

70.38(a)(3)(v) and 70.38(a)(3)(vi) state that the licensee must have been inspected before February 15,1996, and the inspection did not result in the citation of any severity level I, ll, or ill violations or in issuance of any orders or confi7n atory action letters. PSU meets this requirement; and 6.

70.38(a)(3)(viii) states that a criticality monitoring system must not be required in accordance with 10 CFR 70.24. PSU meets this requirement because the only authorized activities for the subcritical assembly are possession, storage, and transfer to another licensee, and not use, as documented in the Safety Evaluation Report for renewal dated June 8,1993.

ENVIRONMENTAL REVIEW Based on the information submitted by PSU, the staff has determined that this revision is an administrative change and will not adversely affect the health and safety or the environment.

Accordingly, the staff has determined that the criteria in 10 CFR 51.22(c)(11) for categorically excluding an action from an environmental review have been met. Tiierefore, neither an Environmental Assessment nor an Environmental Impact Statement is necessary for this proposed action.

CONCLUSION Based on the information submitted by PSU, the staff has determined that the requirements of 10 CFR 70.38(a)(2) have been met, and Lice,9e SNM-95 shall be deemed to have an expiration date five years after the expiration date of the current license. Therefore, the license expires on June 30,2003. The staff concludes that the proposed change will have no adverse affect on the public health and safety or the environment. Approval of the amendment is recommended.

l The NRC Region I inspection staff was contacted and has no objection to this licensing action.
