Pursuant to the provisions of 10 CFR 2.201, attached is Duke Energy Corporation's response to a Notice of Violation dated January 12, 1998 regarding inadequate design controls for RWST setpoint calculation.
This violation was identified during an inspection coriducted on December 1-12, 1997.
Duke Energy Corporation acknowledges this occurrence to be a violation of the requirements of 10 CFR 50, Appendix B, Criterion III, Design Centrol, as implemented by Topical Quality Assurance Program, Amendment 21.

McGuire Nuclear Station Reply to Notice of Violation Restatement of Violation 50-369. 370/97-18-03 10 CFR 50, Appendix B, Criterion III, Design Control, as implemented by Duke Power Company Topical Quality Assurance Program (Duke-1), Amendment 21, requires that casign control measures shall bn provided for verifying or checking the adequacy of design documents, including Quality Assurance Condition 1 design dccuments such as calculations.
Contrary to the above, on December 1-12, 1997, it was identified that inadequate measures were provided for verification or checking the adequacy of design documents.
Errors in computation and design input were identified in McGuire calculation MCC-1552.08-00-0118, Refueling Water Storage Tank Setpoints, revision 2, dated October 26, 1997.
This is a Severity Level IV violation (Supplement I).
Reply to Violation 50-369, 370/97-18-03 1.
Reason for the violation:
During the checking of calculation MCC-1552.08-00-0118, errors in computation and design input in a non-limiting case were not identified.
McGuire has concluded that this error was attributed to human error (inadequate attention to detail) and was an isolated incident.

Corrective steps that have been taken and the results achieved:
Calculation MCC-1552.08-00-0118 was revised on December 10, 1997 (Revision 3) to correct the errors in computation and design input.
The overall conclusions of the calculation were not affected since the corrected case remained non-limiting.
The importance of the checking process was communicated to the Nuclear Engineering Division supervisors.
It was stressed that all errors are significant, even those that do not affect the overall results of a calculation.
Engineering Directive EDM-101, " Engineering Calculations / Analyses," was reviewed to ensure that the responsibilities of the checker are clearly specified.
The existing direction was determined to be sufficient.

McGuire considers this an isolated incident. No further corrective actions are planned.

Date when full compliance will be achieved:
McGuire Nuclear Station is now in full compliance.
