Subject:

PECO Energy Company Peach Bottom AtomidPower Station (PBAPS)

Rod Run Creek Low Flcw Crossing Small Project Joint Permit Application Dear Mr. Rettinger.

As we discussed in our 6/9/97 presentation to you, attachert is a permit apolication for a proposed low flow crossing of the Rock Run Creek located on PECO Energy Co4roperty at PBAPS in Peach Bottom Township, York County, We :re requesting a Pennsylvania Department of Environmental Pro'ection Chapter 105 Water Obst, uction and Encrocchment Permit for encroachtnents to regulated

  • Waters of the Commonwealth' necessary for the construction of tne structure. The project will also require U.S. Army Corps of Engineers' Section 404 regulatory O

approval under the Corps' Pennsylvania State programmatic General Permit (SPGP 1).

In the attached application, we desenbe the proposed low flow crossing. Because the design is still conceptual in nature, it is possible that details of the crossing may be refined. It is our intent that this permit application present a design which would be bounding from a DEP review

(

standpoint Therefore, any design changes which may be required would be environmentally more conservative or of no ertvironmental conseqtience (e g. Smaller width of crossing, 3

i subsurface structural c',' sign changes, etc). These minor changes would be assured to not affect j

the conclusions of the hydrolog// hydraulic study and not increase the overall area disturbed by -

construction. It is requested that your approval of this application allow for such conservative or j_

non-consequential design refinemer.ts.

i If you have any questions or need additionalinformation. please contact Dave Foss at 717 456 j

3013. We appreciate your cooperation in this matter, A check for the $100 application fee is enclosed. Thank you.

I Sincerely, Cool I
