Dear Ms. Quigg:

This is in further response to your letter dated February 6, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), documents I regarding performance of high burnup fuel.

The documents listed on the enclosed Appendix G are being withheld from public disclosure pursuant to Exemption (7)(A) of the F0IA (5 U.S.C. 552(b)(7)(A)) and 10 CFR 9.5(a)(7)(i) of the Commission's regulations. The information withheld consists of investigatory records compiled for law enforcement purposes, the release of which would interfere with an ongoing enforcement proceeding.

Release of this information could allow those being investigated to learn the scope, direction, and focus of investigatory efforts, and thus could possibly allow them to take action to shield potential wrongdoing or a violation of NRC requirements from investigators.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it h:.5 been determined ,

that the information withheld is exempt from production or distlosure and that  !

l its production or disclosure is contrary to the public interest. The person '

l responsible for this denial is Mr. Ben B. Hayes, Director, Office of Investigations.

This denial may be appealed to the Secretary of the Commissicn within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Connission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

This request seeks all records, as defined in 10CFR, Part 9, subpart A, 3ection 9 3 a (b), which refer to or are related to the performance of high burnt fuel and high burnup spent fuel in commercial nuclear power reactors and spent fuel pools in the United States and other countries. High burnup experimentation is also known as " uranium utilization" and " extended burnup."

The records sought are all of those dated or which refer to the period from 19;'s to and including the present date. The enclosed list details scce, (but, by no means all), of the records sought.

Eecause .r., of the statutory exemptions from the Act's mandatory disclosure provisions arrlies, accesa to the requested records should be grantal within ten ('l')0 working days. In the unlikely event, however, that access is denied to any part of the requested records,
