Dear Mr. Driskill:
Your letter to President Clinton has been referred to the Nuclear Regulatory Commission for response. You have expressed concern over the level of security at the Paducah Gaseous Diffusion Plant. Your letter asked the President to support %gislation, pending at the time of the letter, which would assure that the security force remains armed with sidearms and that the security forces have arrest authority.
The Energy and Water Development Appropriations Act,1998 was signed by the President and became law on October 13,1997. It contained language that amended the USEC Privatization Act to mandate that the Department of Energy's (DOE's) guidelines require the presence of an l
adequate number of security guards carrying sidearms to ensure maintenance of security at the I
gaseous diffusion plants. Language was also included to indicate clearly that DOE must provide arrest authcrity for the cecurity forces at the gaseous oiffusion plants.
The DOE has responsibility for implementing the provisions described above. Although NRC physical secur ty regulations for facilities such as the Paducah Gaseous DiWusion Plant, which handle special nuclear material of low strategic significance, do not require armed security forces, these NRC regu!ations do not conflict with the new provisions because they do not prohibit the use of firearms, I trust this letter is responsive to your concerns.

For NRC regulatory purposes, the Paducah Gaseo Diffusion Plant (PGDP) is considered a Category ll! facility which means the facility can only a special nuclear material oflow strategic significance. NRC does not require armed secu.
forces at a Category 111 facility.-
The NRC regulations pertaining to physical security of the ga ous diffusion plants are coltained in Title 10, Code of Federal Regulations, Sections 73.
73.71, and 73.74. The -
NFsC has reviewed and approved USEC's physical protection plan f the PGDP and has cont >uded that, when properly implemented, it provides for adequate pr ection of the common defent;e and security. However, NRC segulations do not conflict with the ly enacted l
provisioil described above which will be implemented by DOE because the N regulations do -
not prohibit tr,e use of sidearms.
