Dear Mr. O'Connor,
This relates to the request from Mr. D. L. Farrar dated June 23, 1986, to give consideration to granting relief from specified action statement requirements of the Technical Specifications to allow the ECCS Systems to be considered operable without compliance with instrument setpoint requirements.
The NRC agrees that some relief is appropriate to allow testing of the Static-0-Ring differential pressure switches and to allow work scheduled during the Unit I refueling outage. The NRC, however, will not grant relief which allows
.the ECCS Systems to be considered operable without compliance with instrument setpoint requirements.
Instead, this letter grants relief from declaring the affected instruments (and therefore affected systems). inoperable solely as a result of the current uncertainty with the Static-0-Ring setpoint repeatability.

This relief is contingent on the following conditions:
1.
Required surveillance on the affected instruments and systems will be continued.
2.
If an instrument is determined inoperable for any reason other than as a result of the current uncertainty with the Static-0-Ring setpoint repeatability, the required Technical Specification actions will be taken.
In this regard, the individual affected action statements for which relief is granted is not specified, since the relief only applies to the declaring of instruments (and therefore affected systems) inoperable solely as a result of the current uncertainty with the Static-0-Ring setpoint repeatability.
3.
If during surveillance or other method, an instrument setpoint is determined to be out of specification, the setpoint will be adjusted to within specification or the instrument declared inoperable.
4.
The affected unit will be in Operational Mode 4 or 5.
The above relief will remain in effect for each unit until the Regional Administrator or his designee gives his concurrence for startup of the respective unit as required by my June'2, 1986,~1etter to C. Reed.
