Section 3.2 of Appendix B, Environmental Protection Plan (non-radiological), of Facility Operating License NPF-37 requires renewals or appeals of the NPDES Permit to be reported to the NRC.

Enclosed is a copy of Byron Station's renewed NPDES permit which became effective May 28, 1986. Also enclosed is a copy of Commonwealth Edison's appeal to the Illinois Pollution control Board regarding several conditions in the new NPDES permit.

The pH shall be in the range 6.0 to 9.0.

Samples taken in compliance with the effluent monitoring requirements shall be taken at a point representative of the discharge, but prior to entry into the receiving stream.

3.

Neither free available chlorine nor total residual chlorine may be discharged from any unit for more than two hours in any one day and not more than one unit in any plant may discharge free available or total residual chlorine at any one time. The reported average concentration and maximum concentration for free available chlorine shall be based on a chlorine concentration curve. The concentration curve shall be generated using grab samples with an analytical frequency of 5 minutes or less during the respective chlorination period allowing for lag time between the time of chlorine injection and the point of sampling.

Concentration curves shall be submitted with Discharge Monitoring Reports. The frequency and duration of the chlorine dosing period plus the amount of chlorine applied shall be reported on Discharge Monitoring Reports.

Discharge of wastewater from this facility must not alone or in combination with other sources cause the receiving stream to violate the following thermal limitations at the edge of the mixing zone which is defined by Section 302.211, Illinois Administration Code, Title 35, Chapter 1, Subtitle C, as amended:

A.

Maximum temperature rise above natural temperature must not exceed 50F (2.80C).

B.

Water temperature at representative locations in the main river shall not exceed the maximum limits in the following table during more than one (1) percent of the hours in the 12-month period ending with any month. Moreover, at no time shall the water temperature at such locations exceed the maximum ifnits in the following table by more than 30F (1.70C).

(Main river temperatures are temperatures of those portions of the river essentially similar to and following the i

same thermal regime as the temperatures of the main flow of the river.)

The discharge of one hundred twerity-four toxic pollutants (FR Vol.

47, No. 224, November 19,1982, pp. 52309, Appendix A) is prohibited in detectable amounts from cooling tower discharges if the pollutants come from cooling tower maintenance chemicals. The use of cooling tower maintenance chemicals containing chromium or zinc is prohibited unless this pemit has been modified to include the use and discharge of these chemicals.

Cossenwealth Edison Company's pre-operational demonstration submitted pursuant to Section 316(b) of the CWA for the Byron Nuclear Power Station was approved by IEPA by letter dated January 2,1979. An operational study of fish impingement shall be conducted during the first year of Unit 1 operation.

There shall be no discharge of polychlorinated biphenyl compounds.

9.

There shall be no discharge of chemical metal cleaning agents and associated rinses unless this permit has been modified to include the new discharge.

10 The pemittee shall monitor Outfalls No. 001(c) and No. 001(d) for the pollutants in Part V-A, B and C of EPA Application Fom 2C of the Consolidated Pemits Program once by composite sample during discharge from these systems when Unit 1 is operating. The analytical results of the above sampling shall be submitted to IEPA, Industrial Unit, Permit Section within 180 days following the discharge from these outfalls under Station operational conditions.

11. The permittee shall record monitoring results on Discharge Monitoring Report Foms using one such fom for each discharge each month.

The completed Discharge Monitoring Report forms shall be submitted to i

IEPA no later than the 28th day of the following month, unless otherwise specified by the pemitting authority.

PETITION FOR REVIEW OF NPDES PERMIT NO. IL 0048313 Commonwealth Edison Company

(" Edison"), by its attorneys, petitions for review of NPDES Permit No.

IL 0048313 (the " Permit") issued April 28, 1986 by the Illinois Environmental Protection Agency (" Agency").

A copy of the Permit is attached to this Petition.

The Permit covers discharges from the Byron Nuclear Power Station, which is located near the Rock River in Byron, Ogle County, Illinois.

One of the plant's two generating units is currently licensed and operating at a total capacity of 1120 mw (net).

Byron's second unit is expected to begin commercial operation in approximately one year and will have a similar capacity.

The Permit establishes discharge limitations, monitoring and reporting requirements for the following discharge points:

Edison seeks review of the Permit with respect to the individual pH limitation specified for outfall 001(a) and the type of sampling required for total suspended solids

("TSS") at outfalls ' 001(e) and 002.

The pH limitation and the sampling requirements are arbitrary, unreasonable and unwarranted in the following respects.

Outfall 001(a) discharges demineralizer regenerant waste to the condenser cooling water basin, where the natural alkalinity of the non process cooling water reacts with and neutralizes the acid in the demineralizer regenerant waste.

This is a chemical reaction, not dilution.

This process of neutralization has been specifically approved in the United States Environmental Protection Agency's Final Development Document for Effluent Limitations Guidelines and Standards and Pre-treatment Standards for the Steam Electric Point Source Category.

Thus, the Agency's separate pH limitation on discharges into the cooling water basin is unreasonable and unwarranted.

This limitation was not contained in any of the public notices of the proposed reissued permit.

Thus, Edison was afforded no opportunity to submit comments on this limitation.

Compliance with the individual pH limitation for outfall 001(a) would require the construction of new facilities.

The Permit nonetheless makes this limit effective on the f

first day the Permit is effective, May 28, 1986.

Agency in failing to provide a reasonable compliance schedule in imposing this new limitation is arbitrary and capricious.

Edison also seeks review of the type of TSS sampling required for outfalls 001(e) and 002.

Outfall 001(e) discharges from the construction runoff basis to the cooling tower closed cycle cooling system, which in turn has a blowdown to the Rock River.

Outfall 002 is an emergency overflow from the construction runoff basin to Woodland 1

Creek.

The permit requires sampling of these outfalls on a 24-hour composite basis.

This requirement is unnecessary and unreasonable.

8.

Outfall 001(e) discharges on only an intermittent basis.

It is therefore unreasonably and unnecessarily burdensome to require Edison to install a system to provide l

24-hour composite sampling.

Such a system would necessarily be flow activated and would place a burden on Edison greatly i

disproportionate to the informational benefit which would be obtained.

For such intermittent discharge, grab sampling i

would be entirely sufficient to monitor TSS and would impose a far more reasonable burden upon Edison.

Outfall 002 is purely an emergency outfall and is seldom, if ever, expected to discharge.

For this reason, it t

- i is unreasonable to require sampling on a 24-hour composite basis.

Again, such a sampling system would be unreasonably burdensome in proportion to the information it would yield.

Since this outfall is expected to discharge, if at all, on a very infrequent basis, grab sampling would be entirely, sufficient to monitor TSS and would impose a far more reasonable burden on Edison.

10.

For both outfalls 001(e) and 002, 24-hour composite sampling would require the design and installation of new facilities.

The permit nonetheless makes such a samoling recuirement effective for each of the two outfalls on the first day the permit is effective, May 28, 1986.

Edison cannot achieve compliance by that date.

The discharge of one hundred twenty-four toxic pollutants (FR Vol.

47. No. 224, November 19,1982, pp. 52309, Appendix A) is prohibited in detectable amounts from cooling tower discharges if the pollutants come from cooling tower maintenance chemicals. The use of cooling tower maintenance chemicals containing chromium or zine is prohibited unless this permit has been modified to include the use and discharge of these chemicals.
